AtRIENNE ENTRE LA FRANCE<br />

ET LA GRANDE-BRETAGNE1,<br />

DU 20 OCTOBRE 1920.<br />

L'enregistrement de cet accord a en lieu<br />

le io fivrier 1921.<br />

I o Cet accord s'applique seulement aux a~ronefs<br />

priv6s et commerciaux dfiment enregistr6s<br />

ce titre par les Gouvernements Franqais et<br />

Britannique respectivement.<br />

Le Gouvernement Fran~ais s'engage h accorder<br />

en temps de paix aux a~ronefs priv~s et<br />

commerciaux du Gouvernement Britannique,<br />

et h charge de r6ciprocit6, la libert6 de passage<br />

inoffensif au-dessus de son territoire et de ses<br />

eaux territoriales, pourvu que soient observdes<br />

les conditions 6noncdes dans le present accord.<br />

20 Le Gouvernement Fran ais et le Gouvernement<br />

Britannique auront la facult6 d'interdire,<br />

pour des raisons d'ordre militaire ou de<br />

s~curit6 publique, le survol de certaines zones<br />

de leur territoire, sous les peines pr6vues par<br />

leur l6gislation et sous reserve qu'il ne sera fait<br />

aucune distinction h cet 6gard entre les a~ronefs<br />

privds des deux Etats. Les zones ainsi interdites<br />

devront 6tre notifides h l'Etat intdress6.<br />

30 Tout adronef s'engageant au-dessus d'une<br />

zone interdite devra imm~diatement donner<br />

tendant dans ses grandes lignes au mbme<br />

et cet accord a rdgi les communications a~riennes<br />

entre la Grande-Bretagne et la France depuis<br />

cette date jusqu'h la conclusion de l'accord d6finitif.<br />

b) Cet accord ne comporte pas d'6change des<br />

ratifications.<br />

No. 85. - PROVISIONAL AGREE-<br />

MENT WITH RESPECT TO AIR<br />

NAVIGATION BETWEEN<br />

GREAT BRITAIN AND FRANCE,<br />

OCTOBER 20, 1920.<br />

English and French official texts forwarded by<br />

His Britannic Majestv's Government. The<br />

registration of the above-mentioned Agreement<br />

took place on Februaryv IO, 1921.<br />

(I) This agreement applies only to private<br />

and commercial aircraft duly registered as<br />

such by the French and British Governments<br />

respectively.<br />

The French Government pledges itself to<br />

grant, in peace time, and on a basis of reciprocity,<br />

freedom of innocent passage above French<br />

territory. and territorial waters, to private and<br />

commercial aircraft of the British Government,<br />

provided that the conditions set forth in the<br />

present agreement are observed.<br />

(2) The French Government and the British<br />

Government shall have the right, for military<br />

reasons or in the interests of public safety, to<br />

prohibit flight above certain areas of their<br />

territory, under the penalties provided by their<br />

legislation and on condition that no distinction<br />

shall be made in this respect, between the private<br />

aircraft of the two States. The said prohibited<br />

areas shall be notified to the State interested.<br />

(3) Every aircraft which finds itself above<br />

a prohibited area shall immediately give the<br />

signal of distress stated in the Air Navigation<br />

I a) According to a communication from a His<br />

Majesty's Air Council ,, forwarded by the Offices<br />

of the Cabinet on April 7, 1921, an informal agreement<br />

to the same general effect had been in operation<br />

since August 25, 1919, and actually governed<br />

the conditions of interstate flying between<br />

Great-Britain and France, from that date<br />

till the conclusion of the final agreement.<br />

b) This agreement does not entail an exchange<br />

of ratifications.
