CONCERNANT LA NAVIGATION
AtRIENNE ENTRE LA FRANCE
ET LA GRANDE-BRETAGNE1,
DU 20 OCTOBRE 1920.

L'enregistrement de cet accord a en lieu
le io fivrier 1921.
I o Cet accord s'applique seulement aux a~ronefs
priv6s et commerciaux dfiment enregistr6s
ce titre par les Gouvernements Franqais et
Britannique respectivement.
Le Gouvernement Fran~ais s'engage h accorder
en temps de paix aux a~ronefs priv~s et
commerciaux du Gouvernement Britannique,
et h charge de r6ciprocit6, la libert6 de passage
inoffensif au-dessus de son territoire et de ses
eaux territoriales, pourvu que soient observdes
les conditions 6noncdes dans le present accord.
20 Le Gouvernement Fran ais et le Gouvernement
Britannique auront la facult6 d'interdire,
pour des raisons d'ordre militaire ou de
s~curit6 publique, le survol de certaines zones
de leur territoire, sous les peines pr6vues par
leur l6gislation et sous reserve qu'il ne sera fait
aucune distinction h cet 6gard entre les a~ronefs
privds des deux Etats. Les zones ainsi interdites
devront 6tre notifides h l'Etat intdress6.
30 Tout adronef s'engageant au-dessus d'une
zone interdite devra imm~diatement donner
1 e signal de d~tresse prdvu au r~glement de
1 a) D'aprbs une communication, 6manant du
Conseil de Sa Majest6 Britannique pour les questions
a6riennes, et transmise par les (( Offices
of the Cabinet)) le 7 avril 1921, un accord nonofficiel
tendant dans ses grandes lignes au mbme
but a 6t6 en vigueur h partir du 25 aofit I919,
et cet accord a rdgi les communications a~riennes
entre la Grande-Bretagne et la France depuis
cette date jusqu'h la conclusion de l'accord d6finitif.
b) Cet accord ne comporte pas d'6change des
ratifications.
No. 85. - PROVISIONAL AGREE-
MENT WITH RESPECT TO AIR
NAVIGATION BETWEEN
GREAT BRITAIN AND FRANCE,
OCTOBER 20, 1920.

His Britannic Majestv's Government. The
registration of the above-mentioned Agreement
took place on Februaryv IO, 1921.
(I) This agreement applies only to private
and commercial aircraft duly registered as
such by the French and British Governments
respectively.
The French Government pledges itself to
grant, in peace time, and on a basis of reciprocity,
freedom of innocent passage above French
territory. and territorial waters, to private and
commercial aircraft of the British Government,
provided that the conditions set forth in the
present agreement are observed.
(2) The French Government and the British
Government shall have the right, for military
reasons or in the interests of public safety, to
prohibit flight above certain areas of their
territory, under the penalties provided by their
legislation and on condition that no distinction
shall be made in this respect, between the private
aircraft of the two States. The said prohibited
areas shall be notified to the State interested.
(3) Every aircraft which finds itself above
a prohibited area shall immediately give the
signal of distress stated in the Air Navigation
I a) According to a communication from a His
Majesty's Air Council ,, forwarded by the Offices
of the Cabinet on April 7, 1921, an informal agreement
to the same general effect had been in operation
since August 25, 1919, and actually governed
the conditions of interstate flying between
Great-Britain and France, from that date
till the conclusion of the final agreement.
b) This agreement does not entail an exchange
of ratifications.
