En me rdfdrant h la note qui m'avait 6t6<br />

adressde par le pr6d6cesseur de Votre Excellence,<br />

M. Rhallys, en date du 21 aofit/3 septembre<br />

de l'annde pass~e, sub. NO 10.509/<br />

10.989, j'ai l'honneur de porter, en ce qui suit,<br />

h la connaissance de Votre Excellence, les<br />

ddcisions prises par mon Gouvernement au<br />

sujet de I'exemption de taxes accorde aux<br />

successions mobili~res des sujets Hell~nes en<br />

Autriche.<br />

Une ordonnance publide par le Ministate<br />

Impdrial et Royal des Finances, le 3 aofit<br />

dr. sub. No 70.680, et dont j'ai l'honneur de<br />

transmettre ci-joint h Votre Excellence le<br />

texte authentique, ddcr~te que les successions<br />

mobili~res des sujets Hell~nes en Autriche seront<br />

- en vertu du principe de rciprocit6 mat&<br />

rielle - affranchies de toute taxe ou droit<br />

prdlev6 sur la transmission de la propridt6.<br />

Le Minist~re Imp6rial et Royal des Finances<br />

croit tout de mbme devoir renouveler en cette<br />

occasion sa d6claration que cette franchise ou<br />

exemption pourra de tout temps 6tre mise<br />

hors vigueur par une modification ultdrieure<br />

des dispositions 16gales relatives au traitement<br />

applicable aux successions 6trangres en gdndral,<br />

et que l'exemption en question ne doit pas 6tre<br />

considdr~e comme bas~e sur la Convention du<br />

12 juin 1856, mais plut6t et exclusivement<br />

sur la rdciprocit6 matdrielle (comparez ma note<br />

du 18 mai 1903, No 211) dont le principe avait<br />

6t6, en son temps, adopt6 et proclam6 par le<br />

Gouvernement Royal.<br />

Faute de tout fondement lgal, l'exemption<br />

de taxes ne saurait tre 6tendue aux taxes<br />

dites # Fondsgebiiren .<br />

ATHENS, September 9, 1904.<br />

With reference to the Note, dated August 21-<br />

September 3rd, No. IO.509/IO.989, which was<br />

addressed to me by Your Excellency's predecessor,<br />

Mr. Rhallys, I have the honour to inform<br />

your Excellency of the decisions taken by my<br />

Government with regard to exemption from<br />

taxation granted to successions to personal<br />

estate by Greek subjects in Austria.<br />

A decree published by the Imperial and<br />

Royal Ministry of Finance, dated August 3rd<br />

last, No. 70.68o, the text of which I have the<br />

honour to forward to your Excellency herewith,<br />

lays down that sucessions to personal estate<br />

by Greek subjects in Austria (by virtue of the<br />

principle of complete reciprocity) shall be<br />

exempted fromm all taxes or duties levied<br />

upon the transfer of property.<br />

The Imperial and Royal Ministry of Finance<br />

feels bound, nevertheless, to take this opportunity<br />

of repeating its declaration that this<br />

exemption may at any time be cancelled by a<br />

subsequent amendment of the general Regulations<br />

relating to the treatment accorded to<br />

foreign successions ; and also that the exemption<br />

in question must not be considered as based<br />

upon the Convention of June 12th 1856, but<br />

rather as based exclusively upon the principle<br />

of complete reciprocity (see my note<br />

of May 18, 1903, No. 211) which had been<br />

already adopted and proclaimed by the Royal<br />

Government.<br />

In view of the absence of any legal basis,<br />

this exemption from taxation cannot be extended<br />

to the taxes known as the " Fondsgebiiren "<br />
