From M. le Baron GUDENUS,
Austro-Hungarian Chargi d'Af/aires,
To M. A. ROMANOS,
Greek Minister for Foreign A//airs.
No. 311.
SIR,
ATHENS, September 9, 1904.
With reference to the Note, dated August 21-
September 3rd, No. IO.509/IO.989, which was
addressed to me by Your Excellency's predecessor,
Mr. Rhallys, I have the honour to inform
your Excellency of the decisions taken by my
Government with regard to exemption from
taxation granted to successions to personal
estate by Greek subjects in Austria.
A decree published by the Imperial and
Royal Ministry of Finance, dated August 3rd
last, No. 70.68o, the text of which I have the
honour to forward to your Excellency herewith,
lays down that sucessions to personal estate
by Greek subjects in Austria (by virtue of the
principle of complete reciprocity) shall be
exempted fromm all taxes or duties levied
upon the transfer of property.
The Imperial and Royal Ministry of Finance
feels bound, nevertheless, to take this opportunity
of repeating its declaration that this
exemption may at any time be cancelled by a
subsequent amendment of the general Regulations
relating to the treatment accorded to
foreign successions ; and also that the exemption
in question must not be considered as based
upon the Convention of June 12th 1856, but
rather as based exclusively upon the principle
of complete reciprocity (see my note
of May 18, 1903, No. 211) which had been
already adopted and proclaimed by the Royal
Government.
In view of the absence of any legal basis,
this exemption from taxation cannot be extended
to the taxes known as the " Fondsgebiiren "
I have the honour, etc....
(Signed) GUDENUS.
