Article 16.
En matire p~nale non politique, lorsque le
Gouvernement de Fun des deux pays jugera
n~cessaire la notification d'un acte de procedure
ou d'un jugement h un individu rsidant sur
le territoire de l'autre pays, la piece transmise
diplomatiquement et accompagn~e d'une traduction
authentique dans la langue du pays
requis, sera, en tant que les lois du pays requis
ne s'y opposent pas, signifi~e h la personne h
la requite du minist~re public du lieu de la
r~sidence par les soins d'un officier compdtent
et roriginal constatant la notification sera
envoy~e par la m~me voie au Gouvernement
requ~rant sans restitution des frais.
Article 17.
Lorsque, dans une cause p6nale non politique,
la comparution personnelle d'un tdmoin sera
jug~e n~cessaire, le Gouvernement du pays oii
r~side le t6moin l'engagera h se rendre 4 l'assignation
qui lui sera adress~e h cet effet, par
voie diplomatique, de la part des autorit~s de
l'autre pays.
En cas de consentement du tdmoin, les frais
de voyage et de s~jour lui seront accordds
d'apr~s les tarifs et r~glements en vigueur dans
le pays oii l'audition devra avoir lieu oji, h son
choix, d'apr~s les tarifs et r~glements de l'Etat
requis. L'Etat requ6rant indiquera le montant
de l'avance que l'Etat requis pourra, sauf remboursement
de l'Etat requ~rant, faire au t~moin
sur la somme int~grale.
Aucun tdmoin, queUe que soit sa nationalit6,
qui, cit6 dans l'un des deux pays, comparaitra
volontairement devant les juges de l'autre
pays, ne pourra y ftre poursuivi ni ddtenu pour
des faits ou condamnations antdrieurs, civils
ou criminels, ni sous pr~texte de complicit6
dans les faits, objets du proc~s oii il figurera
comme t~moin.
Article 18.
Lorsque, dans une cause pdnale non politique,
instruite dans l'un des deux pays, la communication
de pices de conviction ou de documents

In criminal cases of a non-political nature
when the Government of one of the two
countries considers it necessary to communicate
any order or judgment to any person living
in the territory of the other country, the
communication shall be forwarded through
diplomatic channels, together with an authentic
translation thereof into the language of the
country to which the request is made, and shall,
so far as it is not forbidden by the laws of
such country, be notified to the person in
question by a competent official at the request
of the public authority of the place of his
residence ; and the original document certifying
such notification shall be forwarded, free
of cost, through diplomatic channels to the
Government making the request.
Article 17.
In a criminal case of a non-political nature
when the appearence of a witness is deemed
necessary, the Government of the State in
which the witness resides shall call upon him
to comply with the notice which will be served
upon him through diplomatic channels on
behalf of the authorities of the other country.
If the witness consents to appear, the expenses
of the journey and subsistence shall be granted
him in accordance with the rates and regulations
in force in the country where the hearing is to
take place, or, if he prefers it, in accordance
with the rates and regulations of the country
in which he resides. The State making the
request shall inform the State to which the
request is made of the advance which the
latter may make to the witness upon the total
sum, subject to reimbursement by the former
State.
No witness, whatever his nationality, cited
in one of the two countries and voluntarily
appearing before the judges of the other country,
may be proceeded against or detained on the
ground of previous acts or judgments, whether
criminal or civil, or on the ground of complicity
in the acts forming the subject of the process
in which he so appears as witness.
