Article 16.<br />
En matire p~nale non politique, lorsque le<br />
Gouvernement de Fun des deux pays jugera<br />
n~cessaire la notification d'un acte de procedure<br />
ou d'un jugement h un individu rsidant sur<br />
le territoire de l'autre pays, la piece transmise<br />
diplomatiquement et accompagn~e d'une traduction<br />
authentique dans la langue du pays<br />
requis, sera, en tant que les lois du pays requis<br />
ne s'y opposent pas, signifi~e h la personne h<br />
la requite du minist~re public du lieu de la<br />
r~sidence par les soins d'un officier compdtent<br />
et roriginal constatant la notification sera<br />
envoy~e par la m~me voie au Gouvernement<br />
requ~rant sans restitution des frais.<br />
Article 17.<br />
Lorsque, dans une cause p6nale non politique,<br />
la comparution personnelle d'un tdmoin sera<br />
jug~e n~cessaire, le Gouvernement du pays oii<br />
r~side le t6moin l'engagera h se rendre 4 l'assignation<br />
qui lui sera adress~e h cet effet, par<br />
voie diplomatique, de la part des autorit~s de<br />
l'autre pays.<br />
En cas de consentement du tdmoin, les frais<br />
de voyage et de s~jour lui seront accordds<br />
d'apr~s les tarifs et r~glements en vigueur dans<br />
le pays oii l'audition devra avoir lieu oji, h son<br />
choix, d'apr~s les tarifs et r~glements de l'Etat<br />
requis. L'Etat requ6rant indiquera le montant<br />
de l'avance que l'Etat requis pourra, sauf remboursement<br />
de l'Etat requ~rant, faire au t~moin<br />
sur la somme int~grale.<br />
Aucun tdmoin, queUe que soit sa nationalit6,<br />
qui, cit6 dans l'un des deux pays, comparaitra<br />
volontairement devant les juges de l'autre<br />
pays, ne pourra y ftre poursuivi ni ddtenu pour<br />
des faits ou condamnations antdrieurs, civils<br />
ou criminels, ni sous pr~texte de complicit6<br />
dans les faits, objets du proc~s oii il figurera<br />
comme t~moin.<br />
Article 18.<br />
Lorsque, dans une cause pdnale non politique,<br />
instruite dans l'un des deux pays, la communication<br />
de pices de conviction ou de documents<br />
Article 1b.<br />
In criminal cases of a non-political nature<br />
when the Government of one of the two<br />
countries considers it necessary to communicate<br />
any order or judgment to any person living<br />
in the territory of the other country, the<br />
communication shall be forwarded through<br />
diplomatic channels, together with an authentic<br />
translation thereof into the language of the<br />
country to which the request is made, and shall,<br />
so far as it is not forbidden by the laws of<br />
such country, be notified to the person in<br />
question by a competent official at the request<br />
of the public authority of the place of his<br />
residence ; and the original document certifying<br />
such notification shall be forwarded, free<br />
of cost, through diplomatic channels to the<br />
Government making the request.<br />
Article 17.<br />
In a criminal case of a non-political nature<br />
when the appearence of a witness is deemed<br />
necessary, the Government of the State in<br />
which the witness resides shall call upon him<br />
to comply with the notice which will be served<br />
upon him through diplomatic channels on<br />
behalf of the authorities of the other country.<br />
If the witness consents to appear, the expenses<br />
of the journey and subsistence shall be granted<br />
him in accordance with the rates and regulations<br />
in force in the country where the hearing is to<br />
take place, or, if he prefers it, in accordance<br />
with the rates and regulations of the country<br />
in which he resides. The State making the<br />
request shall inform the State to which the<br />
request is made of the advance which the<br />
latter may make to the witness upon the total<br />
sum, subject to reimbursement by the former<br />
State.<br />
No witness, whatever his nationality, cited<br />
in one of the two countries and voluntarily<br />
appearing before the judges of the other country,<br />
may be proceeded against or detained on the<br />
ground of previous acts or judgments, whether<br />
criminal or civil, or on the ground of complicity<br />
in the acts forming the subject of the process<br />
in which he so appears as witness.<br />
