BY THE PRESIDENT OF THE UNITED<br />

STATES OF AMERICA.<br />

A PROCLAMATION.<br />

Whereas, it is provided by the Act of Congress<br />

of March, 4 1909, entitled " An Act to amend<br />

and consolidate the Acts respecting copyright ",<br />

that the benefits of said Acts shall extend to the<br />

work of an author or proprietor who is a citizen<br />

or subject of a foreign state or nation, only<br />

upon certain conditions set forth in Section 8<br />

of said Act, to-wit :<br />

(a) When an alien author or proprietor<br />

shall be domiciled within the <strong>United</strong> States<br />

at the time of the first publication of his<br />

work ; or<br />

(b) When the foreign state or nation of<br />

which such author or proprietor is a citizen<br />

or subject grants either by treaty, convention,<br />

agreement, or law, to citizens of the <strong>United</strong><br />

States the benefit of copyright on substantially<br />

the same basis as to its own citizens, or copyright<br />

protection substantially equal to the<br />

protection secured to such foreign author under<br />

this Act or by treaty; or when such foreign<br />

state or nation is a party to an international<br />

agreement which provides for reciprocity in<br />

the granting of copyright, by the terms of<br />

which agreement the <strong>United</strong> States may, at<br />

its pleasure, become a party thereto ;<br />

And, Whereas, it is also provided by said<br />

Section that " The existence of the reciprocal<br />

conditions aforesaid shall be determined by<br />

the President of the <strong>United</strong> States, by proclamation<br />

made from time to time, as the purposes<br />

of this act may require ; "<br />

And, Whereas, the King of Sweden has<br />

declared, under authority of law, that on and<br />

after February I, 192o, citizens of the <strong>United</strong><br />

States shall be entitled to all the benefits<br />

conferred by the new copyright laws of Sweden,<br />

including the exclusive right to reproduce<br />

their woi ks by means of records or perforated<br />

rolls or any other -appliances for mechanical<br />

reproduction<br />

Attendu qu'il est prvu par la Loi du Congr~s<br />

du 4 mars 19o9, intitulde ( Loi en vue d'amender<br />

et de codifier les lois sur les droits de propri~t6<br />

litt~raire et artistique ,, que les b~n~fices des<br />

dites lois devront s'6tendre aux oeuvres de<br />

tout auteur ou propridtaire, sujet ou ressortissant<br />

d'un Etat ou d'une nation 6trang~re,<br />

mais seulement selon certaines conditions expos~es<br />

h la Section 8 de ladite Loi, h savoir :<br />

a) Lorsqu'un auteur ou propritaire 6tranger<br />

aura 61u domicile aux Etats-Unis, h 1'poque<br />

de la premiere 6dition de ses oeuvres ; ou<br />

b) Lorsque 'Etat ou la nation 6trang~re<br />

dont cet auteur ou propri6taire est sujet ou<br />

ressortissant, accorde par trait6, convention<br />

arrangement ou loi, aux citoyens des Etats-<br />

Unis, les avantages du droit de propri~t6 litt&<br />

raire et ardstique, h des conditions 6quivalentes,<br />

dans 1'ensemble, 5i celles accord~es h<br />

ses propres ressortissants ou une protection<br />

substantiellement 6quivalents h celle accord~e<br />

h un auteur 6tranger par la Loi pr~sente ou<br />

par Trait6. De m~me, lorsque cet Etat 6tranger<br />

ou cette nation est partie un accord international<br />

qui pr~voit la r~ciprocit6 de la proprit6<br />

litt~raire et artistique, accord aux termes<br />

duquel il est loisible aux Etats-Unis d'acc~der.<br />

Attendu qu'il est aussi pr6vu a ladite section<br />

que les conditions de r~ciprocit6 susdites seront<br />

d~finies par le President des Etats-Unis dans<br />

des proclamations r~pdtdes en temps opportun,<br />

et pour ob~ir aux intentions de la pr6sente loi,<br />

et<br />

Attendu que le Roi de Suede, par d~claration<br />

ayant force de loi, a fait savoir que, ds le<br />

Ier f~vrier 1920, les citoyens des Etats-Unis<br />

seront admis h b~n6ficier des avantages conf~r~s<br />

par les nouvelles lois suedoises sur la propri~t6<br />

litt6raire et artistique, y compris le droit<br />

exclusif de faire reproduire leurs oeuvres au<br />

moyen des disques, des rouleaux perfords ou<br />

autres moyens m~caniques de reproduction.<br />
