A LAW TO AMEND THE GUARDIANSHIP OF INFANTS AND<br />

PRODIGALS LAW, 1935.<br />

BE it enacted by His Excellency the Govemor and<br />

Commander-in-Chief of the (jolony of <strong>Cyprus</strong> as<br />

follows:—<br />

1. This Law may be cited as the Guardianship of short title.<br />

Infants and Prodigals (Amendment) Law, 1936, and shall<br />

be read as one with the Guardianship of Infants and<br />

Prodigals Law, 1935, (hereinafter called " the Principal 32 of 1935.<br />

Law"), and the Principal Law and this Law may<br />

together be cited as the Guardianship of Infants and<br />

Prodigals Laws, 1935 and 1936.<br />

2. Section 8 of the Principal Law is hereby amended Amendment<br />

as follows : of section 8<br />

(a) By the insertion at the end of sub-section (2) of 1935!"^ ^^''^<br />

the words ", unless the other party thereto had no<br />

notice of the appointment of a guardian of the<br />

property of the prodigal".<br />

(b) By the insertion of the following sub-section as<br />

sub-section (3):—<br />

*'(3) Any prodigal who enters into any transaction<br />

or contract in sub-section (2) mentioned (other<br />

than a contract for necessaries) without disclosing<br />

to the other party thereto that a guardian of his<br />

property had been appointed under this Law shall<br />

be guilty of an ofifence.<br />

Penalty: Imprisonment for three months or a<br />

fine of fifty pounds or both. "<br />

Objects and Reasons.<br />

Under section 8 (2) of the Principal Law every transaction<br />

or contract (other than one for necessaries) was<br />

null and void unless the consent in writing of the<br />

prodigal's guardian had been obtained. It is considered<br />

that this would operate as a hardship on a person who<br />

had no notice of the appointment of a guardian. <strong>The</strong><br />

sub-section is by section 2 (a) of this Law amended<br />

accordingly.<br />

2. Section 2 (6) of this Law makes it an ofifence for a<br />

prodigal not to disclose to any person with whom he<br />

enters into a contract (other than one for necessaries) that<br />

his property is under guardianship.<br />
