conviction and of any disqualification to which<br />

the convicted person has become subject shall<br />

be endorsed on any licence held by the offender.<br />

(2) A person who by virtue of an order of<br />

the Court under sub-section (1) is disquahfied<br />

from holding or obtaining a licence may appeal<br />

against the order in the same manner as against<br />

a conviction and the Court may, if it thinks<br />

fit, pending the appeal, suspend the operation<br />

of the order,<br />

(3) Where a person who is disquahfied by<br />

virtue of a conviction or order under this section<br />

is the holder of a Ucence, the hcence shaU be<br />

suspended so long as the disqualification<br />

continues in force and the licence so suspended<br />

shall, during the time of suspension, be of no<br />

effect."<br />

Objects and Reasons.<br />

Lender section 5 of the Principal Law a penalty not<br />

exceeding £100 is provided for the breach of any regulation<br />

made thereunder. In consequence of this no motoring<br />

offences, however trivial, are triable by Magistrates, their<br />

jurisdiction being hmited to offences punishable with a fine<br />

not exceeding £25.<br />

<strong>The</strong> object of section 2 of the present Law is to reduce<br />

the penalties for minor motoring offences and thus enable<br />

them to be dealt with by Magistrates.<br />

2. Section 3 of this Law makes provision for deahng<br />

with persons who are under the influence of drink or a<br />

drug while in charge of a motor car on a road or other<br />

pubhc place. Such persons upon conviction may be<br />

sentenced to imprisonment for a period not exceeding one<br />

year or to a fine not exceeding £100 or to both.<br />

3. Under the Principal Law the Courts have power to<br />

order forfeiture or suspension of a hcence to drive a motor<br />

car only if the offender contravenes any provision of the<br />

Motor Car Laws or the regulations made thereunder. This<br />

power, however, can only be exercised in respect of the<br />

unexpired term of the hcence which may, in certain cases,<br />

be of ver}' brief duration and can in no event exceed a<br />

year, hcences being issued annually.<br />

By section 4 of the present Law power is given to the<br />

Court to order that a driver upon conviction for any<br />

offence under the regulations or under any Law in connection<br />

with the driving of a motor car should be disquaUfied for<br />

holding or obtaining a Ucence for such period as the Court<br />

might think fit.<br />
