Legal <strong>Services</strong>: Does More <strong>Trade</strong> Rhyme with Better Justice 79<br />

electronic discovery, document prepar<strong>at</strong>ion, and negoti<strong>at</strong>ion. Legal process outsourc<strong>in</strong>g,<br />

th<strong>at</strong> is, the crossborder supply of fragments of the legal service value<br />

cha<strong>in</strong>, is currently still a rel<strong>at</strong>ively small bus<strong>in</strong>ess. The outsourc<strong>in</strong>g and offshor<strong>in</strong>g<br />

of legal services started with standardized adm<strong>in</strong>istr<strong>at</strong>ive tasks, such as document<br />

edit<strong>in</strong>g and proofread<strong>in</strong>g. Over time, they have moved toward more skill-<strong>in</strong>tensive<br />

work, such as litig<strong>at</strong>ion research and <strong>in</strong>tellectual property cases <strong>in</strong>volv<strong>in</strong>g p<strong>at</strong>ent<br />

research and analysis and the draft<strong>in</strong>g of p<strong>at</strong>ent applic<strong>at</strong>ions. Analysts expect this<br />

trend to cont<strong>in</strong>ue and legal process outsourc<strong>in</strong>g to become a significant export<br />

<strong>in</strong>dustry <strong>in</strong> com<strong>in</strong>g years. Low-<strong>in</strong>come countries th<strong>at</strong> can offer a comb<strong>in</strong><strong>at</strong>ion<br />

of reliable <strong>in</strong>form<strong>at</strong>ion and communic<strong>at</strong>ion technology <strong>in</strong>frastructure and<br />

language-proficient human capital with the required legal expertise will have the<br />

occasion to tap <strong>in</strong>to these bus<strong>in</strong>ess opportunities.<br />

Forrester Research forecasts th<strong>at</strong> the market for outsourced legal services <strong>in</strong><br />

India will expand from US$80 million <strong>in</strong> 2005 to US$4 billion <strong>in</strong> 2015 (Jaksic<br />

2007). However, the export growth of legal services is not limited to the outsourc<strong>in</strong>g<br />

powerhouse, India. Countries as diverse as Argent<strong>in</strong>a, Brazil, Panama, and the<br />

Russian Feder<strong>at</strong>ion have seen dynamic growth <strong>in</strong> legal service exports <strong>in</strong> the<br />

recent past (figure 3.1). Moreover, U.K. law firms are, for example, outsourc<strong>in</strong>g<br />

p<strong>at</strong>ent prosecution work to lawyers <strong>in</strong> South Africa, where the legal educ<strong>at</strong>ion is<br />

rigorous, but wage costs are compar<strong>at</strong>ively low (Wesemann 2007).<br />
