Assess<strong>in</strong>g the Potential of <strong>Services</strong> <strong>Trade</strong> <strong>in</strong> Develop<strong>in</strong>g Countries 13<br />

genu<strong>in</strong>e competition, build<strong>in</strong>g the regul<strong>at</strong>ory <strong>in</strong>stitutions th<strong>at</strong> are needed to remedy<br />

market failures, appropri<strong>at</strong>ely sequenc<strong>in</strong>g service sector reforms, and establish<strong>in</strong>g<br />

mechanisms th<strong>at</strong> promote the availability of essential services, especially among the<br />

poor.<br />

While governments can <strong>in</strong>iti<strong>at</strong>e service reforms unil<strong>at</strong>erally, <strong>in</strong>tern<strong>at</strong>ional<br />

engagement can play an important c<strong>at</strong>alytic role. Thus, <strong>in</strong> recognition of the ris<strong>in</strong>g<br />

importance of the trade <strong>in</strong> services and the regul<strong>at</strong>ory barriers <strong>in</strong> place, services<br />

have been <strong>in</strong>cluded <strong>in</strong> the multil<strong>at</strong>eral trade architecture of the World <strong>Trade</strong><br />

Organiz<strong>at</strong>ion <strong>in</strong> the form of the GATS. <strong>Services</strong> have also fe<strong>at</strong>ured prom<strong>in</strong>ently <strong>in</strong><br />

the process of World <strong>Trade</strong> Organiz<strong>at</strong>ion accession and <strong>in</strong> the large and grow<strong>in</strong>g<br />

network of regional and bil<strong>at</strong>eral trade agreements th<strong>at</strong> have been concluded <strong>in</strong><br />

the past two decades or th<strong>at</strong> are still under negoti<strong>at</strong>ion.<br />

Common restrictions on service supply through<br />

commercial presence<br />

Restrictions on the establishment and oper<strong>at</strong>ion of commercial presence (Mode 3<br />

trade) by foreign companies are common <strong>in</strong> several of the sectors analyzed <strong>in</strong> this<br />

volume. The limit<strong>at</strong>ions on market access revolve around ownership rules for foreign<br />

companies, the type of legal entity th<strong>at</strong> a foreign company is allowed to oper<strong>at</strong>e,<br />

the number of suppliers allowed <strong>in</strong> a specific market, and the value of transactions<br />

or assets. <strong>Trade</strong> restrictions revolv<strong>in</strong>g around n<strong>at</strong>ional tre<strong>at</strong>ment <strong>in</strong>clude<br />

registr<strong>at</strong>ion, authoriz<strong>at</strong>ion, performance, and technology-transfer requirements;<br />

licens<strong>in</strong>g, standards, and qualific<strong>at</strong>ions; and n<strong>at</strong>ionality and residency requirements.<br />

Restrictions on commercial presence assume particular significance if the<br />

services cannot be delivered through crossborder supply. For example, <strong>in</strong> the<br />

health service sector, rules may perta<strong>in</strong> to the form of establishment, foreign ownership,<br />

and n<strong>at</strong>ionality and residency requirements.<br />

Other sectors such as account<strong>in</strong>g are partially protected because of domestic regul<strong>at</strong>ions<br />

on liability <strong>in</strong>sofar as a local accountant is liable for the delivery of certa<strong>in</strong><br />

services. In the case of legal services, rules reflect legal traditions and the legal heritage<br />

and may be designed to achieve a broad set of public policy objectives. To overcome<br />

these limit<strong>at</strong>ions, companies frequently use a comb<strong>in</strong><strong>at</strong>ion of affili<strong>at</strong>ions and<br />

alliances to leverage the specialized expertise of professionals so th<strong>at</strong> the professionals<br />

can serve the <strong>in</strong>tern<strong>at</strong>ional needs of clients. In construction and distribution services,<br />

foreign companies may be required to deposit capital <strong>in</strong> a local bank and may<br />

face discrim<strong>in</strong><strong>at</strong>ion <strong>in</strong> government procurement. Barriers to commercial presence<br />

condition the degree to which the sector modernizes, and they delay the emergence<br />

of the sector from the <strong>in</strong>formal sector, with the result th<strong>at</strong> tax <strong>in</strong>come is forgone.
