Box 6.6: Initi<strong>at</strong>ives to Prevent Corruption <strong>in</strong> Construction Projects<br />

Transparency <strong>Intern<strong>at</strong>ional</strong> (2005b) has developed a list of <strong>in</strong>iti<strong>at</strong>ives th<strong>at</strong> an owner<br />

could take to reduce the risk of corruption <strong>in</strong> a construction project.<br />

Immedi<strong>at</strong>e actions<br />

• Implement an <strong>in</strong>ternal anticorruption code of conduct and management program<br />

committ<strong>in</strong>g the owner to an anticorruption policy<br />

• Prepare contractual document<strong>at</strong>ion th<strong>at</strong> <strong>in</strong>cludes adequ<strong>at</strong>e contractual safeguards,<br />

such as anticorruption warranties, term<strong>in</strong><strong>at</strong>ion, and compens<strong>at</strong>ion rights <strong>in</strong> the<br />

event of corruption<br />

• Undertake gre<strong>at</strong>er due diligence focus<strong>in</strong>g on the owner’s staff <strong>in</strong> key posts and on<br />

agents<br />

• Ensure th<strong>at</strong> all prequalific<strong>at</strong>ion, tender<strong>in</strong>g, and project management procedures<br />

are fair, reasonable, objective, and transparent<br />

• Report alleg<strong>at</strong>ions of corrupt practices to the authorities and to any applicable<br />

trade or professional associ<strong>at</strong>ions; corruption can only be prosecuted if it is<br />

reported<br />

• Respect the m<strong>in</strong>imum standards for public contract<strong>in</strong>g (Transparency <strong>Intern<strong>at</strong>ional</strong><br />

2005c)<br />

Medium-term actions<br />

• Seek to contract only with companies th<strong>at</strong> have implemented an <strong>in</strong>ternal anticorruption<br />

code of conduct and management program<br />

• Support the <strong>in</strong>troduction of an <strong>in</strong>tern<strong>at</strong>ional externally audited ethical standard<br />

th<strong>at</strong> companies can only <strong>at</strong>ta<strong>in</strong> and keep if they implement such an effective code<br />

and management program<br />

• Require the appo<strong>in</strong>tment of an <strong>in</strong>dependent assessor who monitors the prequalific<strong>at</strong>ion,<br />

tender, and execution of a project to ensure, as far as possible, th<strong>at</strong> it is<br />

oper<strong>at</strong>ed free of corruption<br />

• Require the use of a project <strong>in</strong>tegrity pact for both tender and project execution; an<br />

<strong>in</strong>dependent assessor monitors compliance with the pact, which covers sanctions<br />

and arbitr<strong>at</strong>ion mechanisms<br />

• Develop a fair, proportion<strong>at</strong>e, and transparent blacklist<strong>in</strong>g procedure th<strong>at</strong> bans<br />

companies from tender<strong>in</strong>g for the owner’s projects for a specified period of time<br />

after an offense<br />

Remov<strong>in</strong>g rules and regul<strong>at</strong>ions th<strong>at</strong> are unnecessarily<br />

trade restrictive<br />

The construction service sector is generally subject to a large number of regul<strong>at</strong>ions.<br />

These are partly <strong>in</strong> place to counteract neg<strong>at</strong>ive externalities or common<br />

market failures th<strong>at</strong> are associ<strong>at</strong>ed with the supply of construction services and<br />

th<strong>at</strong> affect third parties and society <strong>in</strong> general. Pollution of air and w<strong>at</strong>er and the<br />

gener<strong>at</strong>ion of noise are examples of neg<strong>at</strong>ive externalities <strong>in</strong> the construction<br />

process. The regul<strong>at</strong>ions are also <strong>in</strong> place to help tackle asymmetric <strong>in</strong>form<strong>at</strong>ion
