Develop<strong>in</strong>g countries also have much to ga<strong>in</strong> from unil<strong>at</strong>eral <strong>in</strong>iti<strong>at</strong>ives.<br />
Oper<strong>at</strong><strong>in</strong>g a transparent and competitive government procurement process is<br />
paramount <strong>in</strong> the effort to limit the wasteful spend<strong>in</strong>g of public resources. Transparency<br />
enhances predictability, trust, and fairness <strong>in</strong> the system and, by extension,<br />
forces companies to compete by rais<strong>in</strong>g productivity and lower<strong>in</strong>g costs.<br />
Announcements of government contracts should be adequ<strong>at</strong>ely advertised and<br />
easily accessible. The w<strong>in</strong>n<strong>in</strong>g bids should be announced so th<strong>at</strong> compet<strong>in</strong>g bidders<br />
can assess their shortcom<strong>in</strong>gs and the fairness of the process. Governments<br />
can also establish a body for dispute resolution or <strong>at</strong> least a mechanism to address<br />
compla<strong>in</strong>ts if bidders suspect collusion or discrim<strong>in</strong><strong>at</strong>ion. It is likewise best practice<br />
to allow suppliers to challenge the due process of procurement conduct. The<br />
World Bank’s guidel<strong>in</strong>es on <strong>in</strong>tern<strong>at</strong>ional competitive bidd<strong>in</strong>g provide sound<br />
pr<strong>in</strong>ciples on ways to manage government procurement, and they leave some flexibility<br />
<strong>in</strong> the bidd<strong>in</strong>g process (box 6.5). A standardized <strong>in</strong>form<strong>at</strong>ion technology<br />
system is an excellent tool for shar<strong>in</strong>g <strong>in</strong>form<strong>at</strong>ion and <strong>in</strong>form<strong>in</strong>g prospective<br />
bidders about outstand<strong>in</strong>g projects.<br />

and Advertis<strong>in</strong>g<br />
Timely notific<strong>at</strong>ion of bidd<strong>in</strong>g opportunities is essential <strong>in</strong> competitive bidd<strong>in</strong>g.<br />
Accord<strong>in</strong>g to the World Bank, for projects th<strong>at</strong> <strong>in</strong>clude procurement on the basis of<br />
<strong>in</strong>tern<strong>at</strong>ional competitive bidd<strong>in</strong>g, the borrower is required to prepare and submit a<br />
draft general procurement notice. The World Bank will arrange for its public<strong>at</strong>ion <strong>in</strong><br />
United N<strong>at</strong>ions Development Bus<strong>in</strong>ess. 4 The notice shall conta<strong>in</strong> <strong>in</strong>form<strong>at</strong>ion concern<strong>in</strong>g<br />
the borrower (or prospective borrower), the amount and purpose of the<br />
loan, the scope of procurement under <strong>in</strong>tern<strong>at</strong>ional competitive bidd<strong>in</strong>g, and the<br />
name and address of the borrower’s agency responsible for procurement. If known,<br />
the scheduled d<strong>at</strong>e of issue of prequalific<strong>at</strong>ion or bidd<strong>in</strong>g documents should be <strong>in</strong>dic<strong>at</strong>ed.<br />
The borrower is to ma<strong>in</strong>ta<strong>in</strong> a list of responses to the notice. The rel<strong>at</strong>ed prequalific<strong>at</strong>ion<br />
or bidd<strong>in</strong>g documents should not be released to the public earlier than<br />
eight weeks after the d<strong>at</strong>e of public<strong>at</strong>ion of the notice. The general procurement<br />
notice is to be upd<strong>at</strong>ed annually for all outstand<strong>in</strong>g procurement.<br />
The <strong>in</strong>tern<strong>at</strong>ional community is also to be notified <strong>in</strong> a timely manner of the<br />
opportunities to bid for specific contracts. To th<strong>at</strong> end, <strong>in</strong>vit<strong>at</strong>ions to prequalify or to<br />
bid, as the case may be, are to be advertised as specific procurement notices <strong>in</strong> <strong>at</strong><br />
least one newspaper of n<strong>at</strong>ional circul<strong>at</strong>ion <strong>in</strong> the borrower’s country (and <strong>in</strong> the official<br />
gazette, if any). Such <strong>in</strong>vit<strong>at</strong>ions are also to be transmitted to those who have<br />
expressed <strong>in</strong>terest <strong>in</strong> bidd<strong>in</strong>g <strong>in</strong> response to the general procurement notice. Public<strong>at</strong>ion<br />
of the <strong>in</strong>vit<strong>at</strong>ions <strong>in</strong> United N<strong>at</strong>ions Development Bus<strong>in</strong>ess is encouraged. Borrowers<br />
are also strongly encouraged to transmit such <strong>in</strong>vit<strong>at</strong>ions to embassies and<br />
trade represent<strong>at</strong>ives of countries of likely suppliers and contractors. Additionally, for<br />
large, specialized, or important contracts, borrowers are to advertise the <strong>in</strong>vit<strong>at</strong>ions <strong>in</strong><br />
United N<strong>at</strong>ions Development Bus<strong>in</strong>ess or <strong>in</strong> well-known technical magaz<strong>in</strong>es, newspapers,<br />
and trade public<strong>at</strong>ions of wide <strong>in</strong>tern<strong>at</strong>ional circul<strong>at</strong>ion. Notific<strong>at</strong>ion is to be<br />
given <strong>in</strong> sufficient time to enable prospective bidders to obta<strong>in</strong> prequalific<strong>at</strong>ion or<br />
bidd<strong>in</strong>g documents and prepare and submit their responses.
