Address<strong>in</strong>g explicit trade barriers<br />

Policy makers can identify explicit barriers to the trade <strong>in</strong> environmental services<br />

accord<strong>in</strong>g to the modes of supply described <strong>in</strong> an earlier section on the situ<strong>at</strong>ion<br />

and prospects <strong>in</strong> environmental services.<br />

The major share of the <strong>in</strong>tern<strong>at</strong>ional trade <strong>in</strong> environmental services takes<br />

place through commercial presence. Thus, most restrictions faced by environmental<br />

exporters will rel<strong>at</strong>e to Mode 3. Examples of typical restrictions affect<strong>in</strong>g<br />

commercial presence <strong>in</strong> environmental services <strong>in</strong>clude the follow<strong>in</strong>g:<br />

• An economic needs test for the approval of foreign <strong>in</strong>vestment <strong>in</strong> solid waste<br />

management services, air pollution services, and technical test<strong>in</strong>g and analysis<br />

services<br />

• Numerical quotas on the number of oper<strong>at</strong><strong>in</strong>g licenses available to pro -<br />

viders of <strong>in</strong>dustrial wastew<strong>at</strong>er tre<strong>at</strong>ment services th<strong>at</strong> apply to local and<br />

foreign <strong>in</strong>vestors<br />

• A jo<strong>in</strong>t venture requirement for the supply of environmental, architectural,<br />

construction, and rel<strong>at</strong>ed eng<strong>in</strong>eer<strong>in</strong>g services<br />

• Regul<strong>at</strong>ion of contracts by value and number through an annual licens<strong>in</strong>g system<br />

<strong>in</strong> the construction and eng<strong>in</strong>eer<strong>in</strong>g segment<br />

• N<strong>at</strong>ionality or residency requirements for foreign establishment for companies<br />

oper<strong>at</strong><strong>in</strong>g public utilities, for example, or to ga<strong>in</strong> the right to open a practice <strong>in</strong><br />

professional services, such as architectural eng<strong>in</strong>eer<strong>in</strong>g<br />

• A requirement th<strong>at</strong> foreign bus<strong>in</strong>esses hire specific r<strong>at</strong>ios of domestic staff to<br />

foreign staff<br />

• A reserv<strong>at</strong>ion of some service sectors or activities for n<strong>at</strong>ionals or residents<br />

The supply of environmental services through Mode 3 will often be accompanied<br />

by Mode 4 supply to provide skilled and professional services directly to projects<br />

and to ma<strong>in</strong>ta<strong>in</strong> local offices. Environmental service firms use a variety of professionals,<br />

such as scientists, ecologists, and specialized technicians. The deployment<br />

of these professionals for temporary assignments <strong>in</strong> export markets as a complement<br />

to foreign direct <strong>in</strong>vestment is common <strong>in</strong> the <strong>in</strong>dustry. The movement of<br />

n<strong>at</strong>ural persons is a sensitive issue <strong>in</strong> many countries because of illegal immigr<strong>at</strong>ion<br />

and security concerns. Restrictions on Mode 4 may also arise from a country’s<br />

overall immigr<strong>at</strong>ion policy or specific labor market conditions. Common<br />

examples of specific conditions for the approval of the entry of service suppliers<br />

<strong>in</strong>clude the follow<strong>in</strong>g:<br />

• Labor market test<strong>in</strong>g<br />

• Residency requirements for <strong>in</strong>tracorpor<strong>at</strong>e transferees and a requirement th<strong>at</strong><br />

the foreign company employ specific numbers of local staff
