Annex I-Morocco: Exist<strong>in</strong>g measures th<strong>at</strong> are not subject to some or all relevant provisions<br />

of chapters 10 and 11<br />

Physicians: A foreign physician may engage <strong>in</strong> the priv<strong>at</strong>e practice of medic<strong>in</strong>e only if he or<br />

she fulfills certa<strong>in</strong> conditions, <strong>in</strong>clud<strong>in</strong>g the follow<strong>in</strong>g conditions, which are <strong>in</strong>consistent<br />

with the oblig<strong>at</strong>ions listed above:<br />

(a) have permanent residency <strong>in</strong> Morocco;<br />

(b) have st<strong>at</strong>us as the spouse of a Moroccan n<strong>at</strong>ional or as a n<strong>at</strong>ional of a St<strong>at</strong>e th<strong>at</strong> has<br />

entered <strong>in</strong>to an agreement with Morocco authoriz<strong>in</strong>g a n<strong>at</strong>ional of either St<strong>at</strong>e to<br />

practice medic<strong>in</strong>e <strong>in</strong> the territory of the other St<strong>at</strong>e; and<br />

(c) have government authoriz<strong>at</strong>ion.<br />

Notwithstand<strong>in</strong>g paragraphs (a) and (b), the M<strong>in</strong>istry of Health may authorize foreign<br />

physicians to practice <strong>in</strong> Morocco for periods not exceed<strong>in</strong>g one month with respect to<br />

specialties th<strong>at</strong> do not exist <strong>in</strong> Morocco.<br />

Establish<strong>in</strong>g cl<strong>in</strong>ics or comparable medical facilities: Only physicians who have fulfilled the<br />

requirements for practic<strong>in</strong>g medic<strong>in</strong>e <strong>in</strong> Morocco may establish priv<strong>at</strong>e cl<strong>in</strong>ics and<br />

comparable medical facilities, such as birth<strong>in</strong>g centers, w<strong>at</strong>er therapy (thalassotherapie)<br />

centers, medical care centers and other centers provid<strong>in</strong>g <strong>in</strong>-p<strong>at</strong>ient care for periods of <strong>at</strong><br />

least twenty-four hours, kidney dialysis centers, radiotherapy centers, and chemotherapy<br />

centers.<br />

Pharmacists: In decid<strong>in</strong>g whether to authorize a foreign n<strong>at</strong>ional to practice the profession<br />

of pharmacist, Morocco may take <strong>in</strong>to account the needs of the sector.<br />

Pharmaceutical firms: The establishment <strong>in</strong> Morocco of a firm engaged <strong>in</strong> the manufacture<br />

or wholesale distribution of pharmaceutical products is cont<strong>in</strong>gent on the requirement th<strong>at</strong><br />

51 percent of the capital stock be held by pharmacists. A majority of th<strong>at</strong> 51 percent of<br />

capital stock (i.e., <strong>at</strong> least 26 percent of the total capital stock) must be held by persons<br />

authorized to practice as pharmacists <strong>in</strong> Morocco. In an enterprise established <strong>in</strong> Morocco<br />

and engaged <strong>in</strong> the manufacture or wholesale distribution of pharmaceutical products, the<br />

follow<strong>in</strong>g persons must be pharmacists:<br />

(a) <strong>in</strong> sole proprietorships, the sole proprietor;<br />

(b) <strong>in</strong> corpor<strong>at</strong>ions, the president and one-half plus one of the members of the board of<br />

directors;<br />

(c) <strong>in</strong> limited-liability companies and limited partnerships, all managerial personnel; and<br />

(d) <strong>in</strong> other types of enterprises, all the pr<strong>in</strong>cipals.<br />

Dental surgeons, midwives, nurses, and opticians: In decid<strong>in</strong>g whether to authorize a foreign<br />

n<strong>at</strong>ional to practice the profession of dental surgeon, midwife, nurse, or optician, Morocco<br />

may take <strong>in</strong>to account the needs of the sector.<br />

Priv<strong>at</strong>e biomedical analysis labor<strong>at</strong>ories: A foreign pharmacist, physician, or veter<strong>in</strong>arian may<br />

establish, oper<strong>at</strong>e, and manage a priv<strong>at</strong>e biomedical analysis labor<strong>at</strong>ory only if he or she<br />

fulfills certa<strong>in</strong> conditions, <strong>in</strong>clud<strong>in</strong>g the follow<strong>in</strong>g conditions, which are <strong>in</strong>consistent with<br />

the oblig<strong>at</strong>ions listed above:<br />

(a) have permanent residency <strong>in</strong> Morocco; and<br />

(b) have st<strong>at</strong>us as the spouse of a Moroccan n<strong>at</strong>ional or as a n<strong>at</strong>ional of a St<strong>at</strong>e th<strong>at</strong> has<br />
