dependent on the short-term circul<strong>at</strong>ion of managerial and professional staff and<br />

the medium-term circul<strong>at</strong>ion of builders, welders, crane oper<strong>at</strong>ors, and so on.<br />

In the adjacent eng<strong>in</strong>eer<strong>in</strong>g and architectural service sectors, which are frequently<br />

<strong>in</strong>corpor<strong>at</strong>ed <strong>in</strong>-house <strong>in</strong> mult<strong>in</strong><strong>at</strong>ionals, the nonrecognition of professional<br />

qualific<strong>at</strong>ions may represent another barrier. Local labor policy may also<br />

impose rules on m<strong>in</strong>imum-wage levels th<strong>at</strong> are well above remuner<strong>at</strong>ion levels <strong>in</strong><br />

the country of orig<strong>in</strong> of the export<strong>in</strong>g company.<br />

<strong>Trade</strong>-imped<strong>in</strong>g regul<strong>at</strong>ions are not only imposed <strong>at</strong> the border. Domestic regul<strong>at</strong>ions<br />

affect<strong>in</strong>g foreign providers of services can also have an adverse effect on<br />

trade and work<strong>in</strong>g conditions. For example, entities <strong>in</strong> the Persian Gulf region<br />

employ many millions of foreign construction workers. While the numbers may<br />

<strong>in</strong>dic<strong>at</strong>e an open door policy, local rules th<strong>at</strong> regul<strong>at</strong>e the stay of workers are<br />

prone to abuse (FIDH 2007). For example, temporary service providers who enter<br />

the Gulf countries can only obta<strong>in</strong> entry visas and residence permits if local citizens<br />

or local <strong>in</strong>stitutions employ them. The employer becomes a sponsor<br />

(khafeel) and signs a contract issued by the labor m<strong>in</strong>istry. The contractual agreement<br />

essentially makes the sponsor legally and f<strong>in</strong>ancially responsible for the<br />

service provider and ties the service provider to the sponsor (see Longva 1999,<br />

Baldw<strong>in</strong>-Edwards 2005).<br />

Construction workers from low-<strong>in</strong>come Arab, South Asian, or Southeast Asian<br />

countries often make huge f<strong>in</strong>ancial sacrifices to move to the Persian Gulf, but<br />

they must leave the country if their contracts are refuted or broken. The responsibility<br />

of the sponsor to cover any prospective costs of rep<strong>at</strong>ri<strong>at</strong>ion has led to a<br />

common practice whereby sponsors confisc<strong>at</strong>e the passports of service providers<br />

to control and circumscribe their ability to move. Longva (1999) has reported th<strong>at</strong><br />

any dispute with a sponsor leaves the service provider without legal residence, the<br />

possibility of work<strong>in</strong>g, or, effectively, the possibility of ga<strong>in</strong><strong>in</strong>g legal redress.<br />

Bahra<strong>in</strong> recently abandoned this system, which, accord<strong>in</strong>g to Crown Pr<strong>in</strong>ce<br />

Salman, had, <strong>in</strong> effect, suppressed wages and often cre<strong>at</strong>ed abom<strong>in</strong>able work<strong>in</strong>g<br />

conditions for foreign workers (de Boer and Kalkman 2007).<br />

Review<strong>in</strong>g additional trade-distort<strong>in</strong>g rules and regul<strong>at</strong>ions<br />

Subsidies and other <strong>in</strong>centive schemes granted to domestic construction service<br />

suppliers <strong>in</strong> developed (and develop<strong>in</strong>g) countries can have a discrim<strong>in</strong><strong>at</strong>ory<br />

effect on trade. They are provided <strong>in</strong> many countries for export promotion and to<br />

encourage the development of the domestic construction sector. If the subsidies<br />

are granted exclusively to local companies, they may be <strong>in</strong>consistent with the<br />

n<strong>at</strong>ional tre<strong>at</strong>ment oblig<strong>at</strong>ions of WTO member st<strong>at</strong>es. Research and development<br />

are often supported by grants from governments th<strong>at</strong> give companies <strong>in</strong><br />

advanced markets a competitive edge through the use of <strong>in</strong>form<strong>at</strong>ion technology
