Which Issues Warrant the Attention<br />
of Stakeholders<br />
Our discussion touches on a number of issues th<strong>at</strong> merit the <strong>at</strong>tention of policy<br />
makers as they advance the trade-<strong>in</strong>tegr<strong>at</strong>ion agenda for construction services.<br />
Table 6.6 presents a checklist of questions th<strong>at</strong> might help structure the reflections<br />
and ensure a comprehensive approach to reform.<br />

with<strong>in</strong> the country or across different types of contractors If so, why<br />

there bottlenecks th<strong>at</strong> can be addressed Can the number of required documents and<br />

4. Is the decision-mak<strong>in</strong>g process transparent, and does it <strong>in</strong>volve consult<strong>at</strong>ion with other<br />
<strong>in</strong>terested parties If not, wh<strong>at</strong> can be done to <strong>in</strong>crease transparency and predictability<br />
<strong>in</strong> the process<br />
5. Are there prohibitively high fees or taxes <strong>in</strong>volved <strong>in</strong> the applic<strong>at</strong>ion process Can the<br />
applic<strong>at</strong>ion process be made less expensive, while still tak<strong>in</strong>g <strong>in</strong>to account safety,<br />
health, zon<strong>in</strong>g, and other important consider<strong>at</strong>ions<br />
6. Is there any government body to which a decision can be appealed<br />
Ensur<strong>in</strong>g a fair and transparent government procurement process<br />
1. Wh<strong>at</strong> are the m<strong>in</strong>imum criteria th<strong>at</strong> bidd<strong>in</strong>g companies must fulfill <strong>in</strong> terms of<br />
solvency, proven expertise, and <strong>in</strong>-house capacity Are the criteria <strong>in</strong> l<strong>in</strong>e with regional<br />
or <strong>in</strong>tern<strong>at</strong>ional good practices or are they more or less str<strong>in</strong>gent<br />
2. Does government procurement of <strong>in</strong>frastructure projects allow for subcontract<strong>in</strong>g to<br />
stimul<strong>at</strong>e backward l<strong>in</strong>ks to local small and medium-size enterprises<br />
3. Are government contracts advertised <strong>in</strong> easily accessible media or gazettes Do<br />
government agencies allow for sufficient time <strong>in</strong> the advertisement process<br />
4. Are w<strong>in</strong>n<strong>in</strong>g bids announced to the public<br />
5. Is there any dispute resolution body available to resolve issues <strong>in</strong> the procurement<br />
process<br />
6. Do local authorities offer preference marg<strong>in</strong>s to local contractors If so, wh<strong>at</strong> are the<br />
marg<strong>in</strong>s, and does this help raise particip<strong>at</strong>ion by local contractors If local contractors<br />
already dom<strong>in</strong><strong>at</strong>e the market, do these preference marg<strong>in</strong>s squeeze out prospective<br />
foreign competitors<br />
7. Do government entities tend to pay their contractors accord<strong>in</strong>g to agreed deadl<strong>in</strong>es<br />
If not, wh<strong>at</strong> can be done to improve timely payments to contractors<br />
