Understand<strong>in</strong>g <strong>Trade</strong> <strong>in</strong> Environmental <strong>Services</strong>: Key Issues and Prospects 331<br />
discipl<strong>in</strong>es of the General Agreement on <strong>Trade</strong> <strong>in</strong> <strong>Services</strong> of the World <strong>Trade</strong> Organiz<strong>at</strong>ion<br />
have the potential to affect the ability of governments to regul<strong>at</strong>e the w<strong>at</strong>er<br />
<strong>in</strong>dustry <strong>in</strong> the pursuit of social objectives (Lang 2004). Furthermore, (foreign) priv<strong>at</strong>e<br />
particip<strong>at</strong>ion <strong>in</strong> w<strong>at</strong>er and sanit<strong>at</strong>ion services raises concerns rel<strong>at</strong><strong>in</strong>g to price<br />
<strong>in</strong>creases and the fear th<strong>at</strong> poor people will not be able to afford w<strong>at</strong>er because of the<br />
lack of <strong>in</strong>centives from priv<strong>at</strong>e firms to manage n<strong>at</strong>ural resources <strong>in</strong> a susta<strong>in</strong>able way<br />
(Cossy 2005). These views seem to be supported by a number of high-profile failures<br />
<strong>in</strong> priv<strong>at</strong>iz<strong>at</strong>ion oper<strong>at</strong>ions. For example, <strong>in</strong> Argent<strong>in</strong>a, priv<strong>at</strong>e particip<strong>at</strong>ion through<br />
concession proved an unsuccessful experience, leav<strong>in</strong>g many stakeholders diss<strong>at</strong>isfied.<br />
The Organis<strong>at</strong>ion for Economic Co-oper<strong>at</strong>ion and Development and the World<br />
Bank note th<strong>at</strong> this represents a case <strong>in</strong> which the grant<strong>in</strong>g of a concession to manage<br />
w<strong>at</strong>er services was not supported by an <strong>in</strong>dependent regul<strong>at</strong>ory framework (OECD<br />
and World Bank 2006). Many analysts underl<strong>in</strong>e th<strong>at</strong> liberaliz<strong>at</strong>ion discipl<strong>in</strong>es need<br />
to be preconditioned or complemented by regul<strong>at</strong>ory reforms th<strong>at</strong> <strong>in</strong>crease access to<br />
essential facilities and quality services.<br />
Policy makers <strong>in</strong> develop<strong>in</strong>g countries may have significant scope to facilit<strong>at</strong>e<br />
trade <strong>in</strong> environmental services. They have to be guided by a str<strong>at</strong>egic vision of the<br />
sector and its role <strong>in</strong> overall economic, social, and ecological development.<br />
Although the benefits of liberaliz<strong>at</strong>ion can be important <strong>in</strong> terms of <strong>in</strong>creased efficiency<br />
and service access and affordability, experience has shown th<strong>at</strong> reforms<br />
must be appropri<strong>at</strong>ely designed and supported by a strong regul<strong>at</strong>ory framework.<br />
More competition and better regul<strong>at</strong>ion are vital for the development of the environmental<br />
sector <strong>in</strong> develop<strong>in</strong>g countries. <strong>Trade</strong> reform then needs to be <strong>in</strong>tegr<strong>at</strong>ed<br />
<strong>in</strong>to an open and transparent process of regul<strong>at</strong>ory reform <strong>in</strong> which decisions<br />
on the n<strong>at</strong>ure and pace of reform are supported by careful analysis and an<br />
understand<strong>in</strong>g of best practices.<br />
Establish<strong>in</strong>g a good regul<strong>at</strong>ory environment<br />
The regul<strong>at</strong>ory reform discussion differenti<strong>at</strong>es between environmental <strong>in</strong>frastructure<br />
services and non<strong>in</strong>frastructure environmental services because of the<br />
different types of market and regul<strong>at</strong>ory failures th<strong>at</strong> need to be addressed <strong>in</strong> these<br />
two segments of the <strong>in</strong>dustry.<br />
Ensur<strong>in</strong>g th<strong>at</strong> effective competition delivers efficiency and<br />
low prices to consumers<br />
In environmental <strong>in</strong>frastructure and non<strong>in</strong>frastructure services, effective competition<br />
is essential to <strong>in</strong>creas<strong>in</strong>g efficiency. However, several environmental <strong>in</strong>frastructure<br />
services exhibit n<strong>at</strong>ural monopoly characteristics th<strong>at</strong> can pose special<br />
