Cooper<strong>at</strong>ive Arrangements Are Prevalent<br />

Vehicles for Integr<strong>at</strong>ion<br />

If small local law firms are to benefit from legal service exports, they will often<br />

have to specialize <strong>in</strong> a particular area of law and work closely with domestic or<br />

<strong>in</strong>tern<strong>at</strong>ional partners to provide the scope of services th<strong>at</strong> large-scale clients<br />

demand. Also, cooper<strong>at</strong>ion with foreign partners can be seen as a second-best<br />

solution <strong>in</strong> circumvent<strong>in</strong>g barriers to establishment, mobility, and practice <strong>in</strong> a<br />

partner country.<br />

Indeed, trade <strong>in</strong> legal services is frequently undertaken through various forms<br />

of cooper<strong>at</strong>ion between law firms of different n<strong>at</strong>ional orig<strong>in</strong>s. Because of the<br />

gre<strong>at</strong>er access to new <strong>in</strong>form<strong>at</strong>ion and communic<strong>at</strong>ion technologies, who <strong>in</strong> the<br />

legal partnership network actually delivers legal services will depend on the practice<br />

area, the law firm, the client, the jurisdictions <strong>in</strong>volved, and the respective regul<strong>at</strong>ory<br />

frameworks. Depend<strong>in</strong>g on the particular regul<strong>at</strong>ory environment and the<br />

client needs, cooper<strong>at</strong>ion arrangements among global and local law firms may<br />

take the form of the follow<strong>in</strong>g:<br />

• <strong>in</strong>tegr<strong>at</strong>ed <strong>in</strong>tern<strong>at</strong>ional partnerships<br />

• associ<strong>at</strong>ions of <strong>in</strong>dependent local practices<br />

• local firms hir<strong>in</strong>g foreign practitioners<br />

• <strong>in</strong>tern<strong>at</strong>ional firms hir<strong>in</strong>g local lawyers<br />

• <strong>in</strong>tern<strong>at</strong>ional firms establish<strong>in</strong>g partnerships with local lawyers<br />

• contractual outsourc<strong>in</strong>g arrangements<br />

• practitioners serv<strong>in</strong>g as foreign legal consultants (box 3.4)<br />

Reductions <strong>in</strong> costs and improvements <strong>in</strong> the performance of <strong>in</strong>form<strong>at</strong>ion and<br />

communic<strong>at</strong>ions technology have facilit<strong>at</strong>ed collabor<strong>at</strong>ion between law firms and<br />

bus<strong>in</strong>ess rel<strong>at</strong>ions between law firms and clients <strong>in</strong> different countries. Law firms<br />

are leverag<strong>in</strong>g networked practices to broaden and deepen their area of expertise.<br />

This type of partnership can be particularly useful for small and medium law<br />

firms <strong>in</strong> compet<strong>in</strong>g for bus<strong>in</strong>ess with large, mult<strong>in</strong><strong>at</strong>ional clients. For example,<br />

practitioners from more than 60 countries, <strong>in</strong>clud<strong>in</strong>g Algeria, Ecuador, Morocco,<br />

Nigeria, Pakistan, Papua New Gu<strong>in</strong>ea, Thailand, Ukra<strong>in</strong>e, and Vietnam, particip<strong>at</strong>e<br />

<strong>in</strong> the onl<strong>in</strong>e <strong>Intern<strong>at</strong>ional</strong> Lawyers Network (http://www.iln.com/) to<br />

engage clients electronically on m<strong>at</strong>ters of commercial law, litig<strong>at</strong>ion, and contract<strong>in</strong>g.<br />

Also, the Lex Africa law communityprovides a network of law firms <strong>in</strong> 27<br />

African countries th<strong>at</strong> specialize <strong>in</strong> corpor<strong>at</strong>e and commercial law. Networked
