Legal <strong>Services</strong>: Does More <strong>Trade</strong> Rhyme with Better Justice 85<br />

<strong>in</strong>dependent regul<strong>at</strong>ory body with nonlawyer represent<strong>at</strong>ion, and establish<strong>in</strong>g an<br />

office for consumer compla<strong>in</strong>ts and review (Peel 2007).<br />

Similarly, <strong>in</strong> 2005, Japan undertook reforms of its legal service market to<br />

<strong>in</strong>crease productivity <strong>in</strong> the economy. It lifted a number of restrictions to enhance<br />

the function<strong>in</strong>g of the legal system, <strong>in</strong>crease the availability of legal services, and<br />

improve the handl<strong>in</strong>g of bus<strong>in</strong>ess m<strong>at</strong>ters. The bus<strong>in</strong>ess community acted as a c<strong>at</strong>alyst<br />

for this change, argu<strong>in</strong>g th<strong>at</strong> enhanced cooper<strong>at</strong>ion between Japanese and<br />

foreign lawyers would provide better legal services (Goodw<strong>in</strong> 2005). In particular,<br />

bus<strong>in</strong>ess represent<strong>at</strong>ives urged the government to lift market-access restrictions,<br />

raise standards of due diligence for commercial transactions, <strong>in</strong>crease confidence<br />

<strong>in</strong> commercial contracts to <strong>at</strong>tract <strong>in</strong>vestment, and <strong>in</strong>crease the availability of<br />

cross-jurisdictional advice. As a result of the reforms, foreign firms can establish<br />

jo<strong>in</strong>t offices with Japanese <strong>at</strong>torneys to offer legal services. Foreign firms can also<br />

employ Japanese lawyers and offer a broader range of expertise. Japanese<br />

practitioners have therefore ga<strong>in</strong>ed gre<strong>at</strong>er exposure to new bus<strong>in</strong>ess and new<br />

practice areas.<br />

Enhanc<strong>in</strong>g the Skill Base to Strengthen<br />

Domestic Law Firms<br />

Labor costs represent as much as 75 percent of the expenditures of law firms,<br />

reflect<strong>in</strong>g a concentr<strong>at</strong>ion of value <strong>in</strong> the expertise of professional staff (table 3.6).<br />

Hence, recruit<strong>in</strong>g, nurtur<strong>in</strong>g, and reta<strong>in</strong><strong>in</strong>g highly qualified staff are key to<br />

the competitiveness of law firms. At the same time, lawyers <strong>in</strong> firms have to be<br />

m<strong>in</strong>dful of their service delivery costs because clients are becom<strong>in</strong>g more and<br />

more sophistic<strong>at</strong>ed <strong>in</strong> compar<strong>in</strong>g and evalu<strong>at</strong><strong>in</strong>g the cost-effectiveness of the legal<br />

services they receive (box 3.7).<br />
