On the bil<strong>at</strong>eral level, export promotion activities can help domestic law firms<br />

build rel<strong>at</strong>ionships with potential partners and clients. Such efforts can be used to<br />

<strong>in</strong>troduce and m<strong>at</strong>ch law firms with foreign partners, <strong>in</strong>clude law firms <strong>in</strong> <strong>in</strong>dustry<br />

exhibitions abroad and <strong>at</strong> home, tra<strong>in</strong> firm represent<strong>at</strong>ives <strong>in</strong> export market<br />

research, or take other measures to facilit<strong>at</strong>e trade. Box 3.9 provides an example of<br />

a particular type of trade facilit<strong>at</strong><strong>in</strong>g arrangement perta<strong>in</strong><strong>in</strong>g to the crossborder<br />

movement of professionals.<br />

Movement<br />

Often, lawyers must cross borders to visit and represent clients abroad. Cumbersome,<br />

unpredictable, and slow visa procedures are serious obstacles to trade <strong>in</strong> legal services.<br />

Concessions under Mode 4 of the GATS are a major request of develop<strong>in</strong>g countries <strong>in</strong><br />

the Doha Round of multil<strong>at</strong>eral trade negoti<strong>at</strong>ions. However, no compromise has so<br />

far been found. Yet, pragm<strong>at</strong>ic solutions can sometimes be discovered <strong>at</strong> the bil<strong>at</strong>eral<br />

or regional level to facilit<strong>at</strong>e the movement of professionals.<br />

The fear of a host country is th<strong>at</strong> a nonresident enter<strong>in</strong>g its territory overstays and<br />

becomes an illegal immigrant. Temporary movement is often seen as a stepp<strong>in</strong>gstone<br />

for permanent migr<strong>at</strong>ion. Countries therefore tend to be more restrictive than<br />

necessary for the <strong>at</strong>tribution of bus<strong>in</strong>ess and other temporary visas. Yet, a guarantor<br />

for the return of the travel<strong>in</strong>g professional might, <strong>in</strong> this context, overcome the<br />

concerns of the host country about illegal immigr<strong>at</strong>ion. And, <strong>in</strong> the case of the legal<br />

profession (or, similarly, for other professions), the bar of lawyers could play this<br />

guarantor role because formal registr<strong>at</strong>ion to this professional body is often<br />

mand<strong>at</strong>ory, and members are well identified, <strong>in</strong>corpor<strong>at</strong>ed, and established.<br />

In Tunisia, a number of professions have negoti<strong>at</strong>ed a fast-track visa procedure<br />

with the French Consul<strong>at</strong>e. Thus, the professional body of accountants collects<br />

requests for bus<strong>in</strong>ess visas from its members, submits them to the consul<strong>at</strong>e, and<br />

receives multiple-entry visas with<strong>in</strong> a day or two. The eng<strong>in</strong>eers have negoti<strong>at</strong>ed a<br />

similar arrangement and have different priority lists depend<strong>in</strong>g on the seniority of the<br />

member and the type of bus<strong>in</strong>ess. The professional body can therefore assess the<br />

credibility and urgency of each request. As a side benefit, this system also helps keep<br />

track of professional movement and <strong>in</strong>tern<strong>at</strong>ional transactions, thereby contribut<strong>in</strong>g<br />

to the collection of better d<strong>at</strong>a on the trade <strong>in</strong> legal services.
