Eng<strong>in</strong>eer<strong>in</strong>g <strong>Services</strong>: How to Compete <strong>in</strong> the Most Global of the Professions 307<br />

legisl<strong>at</strong>ive, regul<strong>at</strong>ory, and adm<strong>in</strong>istr<strong>at</strong>ive changes <strong>at</strong> home. Stakeholders can<br />

support negoti<strong>at</strong>ions and the consequent tasks associ<strong>at</strong>ed with implement<strong>in</strong>g<br />

trade commitments. 1<br />

Us<strong>in</strong>g <strong>in</strong>tern<strong>at</strong>ional negoti<strong>at</strong>ions to advance eng<strong>in</strong>eer<strong>in</strong>g<br />

export <strong>in</strong>terests<br />

<strong>Trade</strong> negoti<strong>at</strong>ions can achieve n<strong>at</strong>ional tre<strong>at</strong>ment and market access for eng<strong>in</strong>eer<strong>in</strong>g<br />

firms. For example, <strong>in</strong> regional markets, eng<strong>in</strong>eer<strong>in</strong>g firms reportedly<br />

encounter discrim<strong>in</strong><strong>at</strong>ory tre<strong>at</strong>ment rel<strong>at</strong>ive to n<strong>at</strong>ional firms. In Europe, foreign<br />

eng<strong>in</strong>eer<strong>in</strong>g firms reportedly are subject to requirements th<strong>at</strong> they establish<br />

local offices to practice, and they encounter discrim<strong>in</strong><strong>at</strong>ory tre<strong>at</strong>ment rel<strong>at</strong>ive to<br />

n<strong>at</strong>ional and third-country firms (World Bank 2007). Tunisian eng<strong>in</strong>eer<strong>in</strong>g<br />

firms face double tax<strong>at</strong>ion because of a lack of bil<strong>at</strong>eral and regional tax tre<strong>at</strong>ies<br />

(World Bank 2008). The absence of bil<strong>at</strong>eral tax arrangements can reduce the<br />

returns on exports and make export prospects untenable.<br />

<strong>Trade</strong> agreements <strong>at</strong> the bil<strong>at</strong>eral, regional, or multil<strong>at</strong>eral level can effectively<br />

improve the market environment <strong>at</strong> home. For example, Morocco has engaged <strong>in</strong><br />

bil<strong>at</strong>eral arrangements with provisions to facilit<strong>at</strong>e trade <strong>in</strong> eng<strong>in</strong>eer<strong>in</strong>g. A recent<br />

free trade agreement conta<strong>in</strong>s substantial transparency provisions th<strong>at</strong> require the<br />

establishment of contact po<strong>in</strong>ts, the prompt public<strong>at</strong>ion of rules, and opportunity<br />

for comment on the rules. Crossborder trade provisions enable the parties to the<br />

agreement to pursue the mutual recognition of professional qualific<strong>at</strong>ions. Parties<br />

allow for the temporary admission of goods with regard to specialized equipment<br />

frequently used <strong>in</strong> eng<strong>in</strong>eer<strong>in</strong>g. Government procurement provisions require<br />

open procurement processes (Bennett 2004). Implement<strong>at</strong>ion requires <strong>in</strong>vestment<br />

<strong>in</strong> public policy procedures.<br />

Engagement <strong>in</strong> service negoti<strong>at</strong>ions under the General Agreement on <strong>Trade</strong> <strong>in</strong><br />

<strong>Services</strong> of the World <strong>Trade</strong> Organiz<strong>at</strong>ion also offers a vehicle to address barriers<br />

to trade <strong>in</strong> eng<strong>in</strong>eer<strong>in</strong>g services <strong>at</strong> a multil<strong>at</strong>eral level. A review of the pluril<strong>at</strong>eral<br />

requests on eng<strong>in</strong>eer<strong>in</strong>g services can help policy makers understand the parameters<br />

of negoti<strong>at</strong>ions. For example, the requests highlight the removal of n<strong>at</strong>ionality<br />

requirements, residency requirements, rules th<strong>at</strong> restrict a particular type of legal<br />

entity, limit<strong>at</strong>ions on the particip<strong>at</strong>ion of foreign capital, and jo<strong>in</strong>t ventures<br />

(<strong>Intern<strong>at</strong>ional</strong> <strong>Trade</strong> Canada 2006). Engagement <strong>in</strong> negoti<strong>at</strong>ions can also expose<br />

World <strong>Trade</strong> Organiz<strong>at</strong>ion members to market concerns across the spectrum of<br />

economies. Engagement requires a comprehensive approach and an understand<strong>in</strong>g<br />

of the potential trade-offs <strong>in</strong>volved <strong>in</strong> each aspect of the Doha Round. Regional<br />

arrangements can also foster <strong>in</strong>tegr<strong>at</strong>ion <strong>in</strong> the eng<strong>in</strong>eer<strong>in</strong>g service trade<br />

(box 9.4).
