list of nonconform<strong>in</strong>g measures, and Mode 4 is tre<strong>at</strong>ed <strong>in</strong> a chapter on the temporary<br />

movement of bus<strong>in</strong>ess persons. This chapter def<strong>in</strong>es movement for the four<br />

c<strong>at</strong>egories usually seen <strong>in</strong> trade agreements (traders and <strong>in</strong>vestors, BVs, ICTs, and<br />

IPs). However, Japan has set a time limit of three years for three of these c<strong>at</strong>egories<br />

(all but bus<strong>in</strong>ess visitors), which is a fairly generous <strong>in</strong>terpret<strong>at</strong>ion of length of stay.<br />

The two more recent RTAs negoti<strong>at</strong>ed by Japan with countries <strong>in</strong> Southeast<br />

Asia—Indonesia and the Philipp<strong>in</strong>es—are notable for their <strong>in</strong>nov<strong>at</strong>ions <strong>in</strong> cover<strong>in</strong>g,<br />

for the first time, specific c<strong>at</strong>egories of nurses and care workers. These RTAs<br />

also have expanded the c<strong>at</strong>egories of workers <strong>in</strong> the chapter on Mode 4 to <strong>in</strong>clude<br />

“professionals with personal contracts” (essentially the same as CSSs), as well as<br />

nurses and care workers. For Japan, these c<strong>at</strong>egories (other than bus<strong>in</strong>ess visitors)<br />

are allowed a stay of up to three years. Japan has also <strong>in</strong>creased the number of professional<br />

c<strong>at</strong>egories covered <strong>in</strong> the annex on professionals <strong>in</strong> these two RTAs (to 14<br />

<strong>in</strong> the case of Indonesia and 10 <strong>in</strong> the case of the Philipp<strong>in</strong>es). No numerical limits<br />

are placed on these professional c<strong>at</strong>egories, except for nurses and care workers,<br />

for whom an annual quota is <strong>in</strong> effect. For the l<strong>at</strong>ter professions, specific educ<strong>at</strong>ion<br />

and tra<strong>in</strong><strong>in</strong>g requirements are also <strong>in</strong>cluded <strong>in</strong> the agreements, namely, a<br />

n<strong>at</strong>ional health degree, plus two years of prior work experience and six months of<br />

language tra<strong>in</strong><strong>in</strong>g <strong>in</strong> Japanese. Professional c<strong>at</strong>egories are allowed a stay of up to<br />

three years. The specific<strong>at</strong>ion of particular c<strong>at</strong>egories of work with annual quotas<br />

and tra<strong>in</strong><strong>in</strong>g requirements is an <strong>in</strong>nov<strong>at</strong>ive approach th<strong>at</strong> has not yet been seen <strong>in</strong><br />

other RTAs.<br />

RTAs negoti<strong>at</strong>ed by Australia and New Zealand<br />

Four RTAs have been negoti<strong>at</strong>ed by Australia and New Zealand th<strong>at</strong> are relevant<br />

for this study, <strong>in</strong>clud<strong>in</strong>g one jo<strong>in</strong>t RTA with the 10 members of the Associ<strong>at</strong>ion of<br />

Southeast Asian N<strong>at</strong>ions (ASEAN). They are summarized <strong>in</strong> table 2.7. Three of<br />

these are recent agreements th<strong>at</strong> have been signed or have come <strong>in</strong>to force s<strong>in</strong>ce<br />

August 2008. The oldest of the four and the one with the least ambitious provisions<br />

for labor mobility is the P4, also known as the Trans-Pacific Str<strong>at</strong>egic Economic<br />

Partnership Agreement, between the four countries of Brunei Darussalam,<br />

Chile, New Zealand, and S<strong>in</strong>gapore. This agreement, which entered <strong>in</strong>to force <strong>in</strong><br />

2006, follows a NAFTA-type structure, but with less <strong>in</strong>-depth content. The only<br />

c<strong>at</strong>egory of workers specified <strong>in</strong> the temporary entry (or labor mobility) chapter is<br />

bus<strong>in</strong>ess persons, and no length of stay is specified. There is an annex for professional<br />

services, but it primarily sets out a best endeavors clause for the development<br />

of “mutually acceptable standards and criteria for licens<strong>in</strong>g and certific<strong>at</strong>ion<br />

of professional service providers.” No professional c<strong>at</strong>egories of service providers<br />

are listed; therefore, the annex has no market access component.
