th<strong>at</strong> allowed for an annual quota of 10,500 professionals from Australia to be granted access to the U.S.<br />

market. This was done <strong>in</strong> 2002, and it proved to be the f<strong>in</strong>al straw <strong>in</strong> this area for some members of the<br />

U.S. Congress.<br />

5. Sáez (2009) argues th<strong>at</strong>, with<strong>in</strong> the EU, issues <strong>in</strong> the trade <strong>in</strong> services do not fall exclusively under<br />

the competence of EU-wide entities because the issues go beyond articles of the tre<strong>at</strong>y th<strong>at</strong> accords<br />

supran<strong>at</strong>ional tre<strong>at</strong>y-mak<strong>in</strong>g powers to these entities on behalf of all the member st<strong>at</strong>es. Thus, <strong>in</strong><br />

implement<strong>in</strong>g the service provisions and oblig<strong>at</strong>ions of a trade agreement, these elements must be<br />

approved by each EU member st<strong>at</strong>e <strong>in</strong> accordance with domestic laws.<br />

6. However, several EU member st<strong>at</strong>es have <strong>at</strong>tached economic needs test<strong>in</strong>g requirements <strong>in</strong> their<br />

commitments on Mode 4 entry. The actual access provided, even under the expanded commitments,<br />

depends on how the tests are <strong>in</strong>terpreted and applied.<br />

7. A recent RTA between the members of the European Free <strong>Trade</strong> Associ<strong>at</strong>ion and Colombia,<br />

signed on November 25, 2008, does not even <strong>in</strong>clude an annex on professional service suppliers and<br />

conta<strong>in</strong>s no mention of the movement of n<strong>at</strong>ural persons other than their def<strong>in</strong>ition as Mode 4 <strong>in</strong> the<br />

body of the agreement.<br />

8. The <strong>Intern<strong>at</strong>ional</strong> Labour Organiz<strong>at</strong>ion has developed a multil<strong>at</strong>eral framework on labor migr<strong>at</strong>ion<br />

th<strong>at</strong> constitutes a comprehensive collection of pr<strong>in</strong>ciples, guidel<strong>in</strong>es, and good practices on labor<br />

migr<strong>at</strong>ion programs, <strong>in</strong>clud<strong>in</strong>g BLAs. See ILO (2006).<br />

9. A few recent memorandums of understand<strong>in</strong>g on migr<strong>at</strong>ory and labor cooper<strong>at</strong>ion have been<br />

signed between develop<strong>in</strong>g countries, for example, between Peru and Chile (2006), Peru and Ecuador<br />

(2006), and Peru and Mexico (2002). These aim <strong>at</strong> exchang<strong>in</strong>g <strong>in</strong>form<strong>at</strong>ion and protect<strong>in</strong>g the rights of<br />

migrant workers, but do not <strong>in</strong>clude provisions to promote labor mobility. The Philipp<strong>in</strong>es has signed<br />

bil<strong>at</strong>eral memorandums of understand<strong>in</strong>g with several countries to cover the flows, rights, and oblig<strong>at</strong>ions<br />

of its n<strong>at</strong>ionals who become temporary workers. A reciprocal temporary worker program has<br />

also been signed between Argent<strong>in</strong>a and Bolivia th<strong>at</strong> <strong>in</strong>cludes many of these protections.<br />
