n<strong>at</strong>ional tre<strong>at</strong>ment regul<strong>at</strong>ions may be horizontal r<strong>at</strong>her than sector specific, they<br />
still affect the oper<strong>at</strong>ional flexibility of <strong>in</strong>tern<strong>at</strong>ional contractors, <strong>in</strong>clud<strong>in</strong>g the<br />
exposure of these contractors to risk and the possibilities for mak<strong>in</strong>g profits and<br />
rep<strong>at</strong>ri<strong>at</strong><strong>in</strong>g earn<strong>in</strong>gs to headquarters. The prospect of oper<strong>at</strong><strong>in</strong>g an entity without<br />
full control reduces the prospective ga<strong>in</strong>s from competition by foreign companies.<br />
F<strong>in</strong>ally, market access is only allowed <strong>in</strong> some countries if the appropri<strong>at</strong>e<br />
resources and <strong>in</strong>put m<strong>at</strong>erials are <strong>in</strong>accessible on the local market.<br />
Table 6.5 shows the frequency of measures rel<strong>at</strong>ed to market access and<br />
n<strong>at</strong>ional tre<strong>at</strong>ments. While crossborder supply and consumption abroad are rel<strong>at</strong>ively<br />
unaffected by restrictions, commercial presence (particularly for market<br />
access) and the presence of n<strong>at</strong>ural persons (particularly for n<strong>at</strong>ional tre<strong>at</strong>ment)<br />
are the ma<strong>in</strong> target modes of supply for restrictions. The key negoti<strong>at</strong><strong>in</strong>g objectives<br />
for construction services as identified by WTO members <strong>in</strong> the Doha Round<br />
of multil<strong>at</strong>eral trade negoti<strong>at</strong>ions <strong>in</strong>clude, for commercial presence, various foreign<br />
equity limit<strong>at</strong>ions, jo<strong>in</strong>t venture and jo<strong>in</strong>t oper<strong>at</strong>ion requirements, discrim<strong>in</strong><strong>at</strong>ory<br />
licens<strong>in</strong>g and registr<strong>at</strong>ion procedures, and restrictions on the types of projects th<strong>at</strong><br />
can be undertaken by foreign suppliers of services (WTO 2005). Policy makers <strong>in</strong><br />
develop<strong>in</strong>g countries may scrut<strong>in</strong>ize their commitments <strong>in</strong> WTO and assess which<br />
of these restrictions are deemed effective and least trade restrictive <strong>in</strong> terms of the<br />
st<strong>at</strong>ed purposes.<br />
Identify<strong>in</strong>g market access restrictions on temporary transfers of foreign<br />
project staff<br />
In the construction service sector, with its <strong>in</strong>tensive use of labor, the often str<strong>in</strong>gent<br />
limit<strong>at</strong>ions on the temporary movement of n<strong>at</strong>ural persons are particularly<br />
serious impediments. These restrictions often disproportionally affect service<br />
providers from poor countries <strong>in</strong> which there is an abundant supply of low-skilled<br />
and medium-skilled construction workers will<strong>in</strong>g to leave home and take up<br />
physically demand<strong>in</strong>g jobs abroad. The restrictions are seldom part of official<br />
trade policy, but, r<strong>at</strong>her, are formul<strong>at</strong>ed as part of labor market regul<strong>at</strong>ions and<br />
immigr<strong>at</strong>ion policy. It is therefore especially challeng<strong>in</strong>g for policy makers to<br />
overcome these regul<strong>at</strong>ions through trade negoti<strong>at</strong>ions. It is also an area of political<br />
sensitivity.<br />
The range of limit<strong>at</strong>ions on the temporary movement of n<strong>at</strong>ural persons is<br />
wide and covers measures from bans and quotas to economic needs tests and residency<br />
requirements. Even if workers fulfill the criteria for work permits, the<br />
adm<strong>in</strong>istr<strong>at</strong>ion of these documents for employees of <strong>in</strong>tern<strong>at</strong>ional contractors can<br />
be bureaucr<strong>at</strong>ic and tedious to the extent th<strong>at</strong> the adm<strong>in</strong>istr<strong>at</strong>ion delays projects,<br />
thereby <strong>in</strong>creas<strong>in</strong>g oper<strong>at</strong><strong>in</strong>g costs and mak<strong>in</strong>g project execution unpredictable.<br />
In particular, new market entrants, without a local base of professionals, are
