protection of <strong>in</strong>tellectual property rights <strong>in</strong> consumer products is easier to carry<br />

out among large retail cha<strong>in</strong>s, which can be monitored and prosecuted for<br />

<strong>in</strong>fr<strong>in</strong>gements, whereas small companies and market stalls can usually avoid<br />

preventive measures undertaken by the authorities.<br />

The prepar<strong>at</strong>ions for the trade liberaliz<strong>at</strong>ion of distribution services will entail<br />

a review of the exist<strong>in</strong>g regul<strong>at</strong>ions th<strong>at</strong> govern market access for foreign <strong>in</strong>vestors<br />

and their ongo<strong>in</strong>g oper<strong>at</strong>ions once they have been established, whether the regul<strong>at</strong>ions<br />

are specifically imposed on the <strong>in</strong>vestors or result from domestic regul<strong>at</strong>ions<br />

th<strong>at</strong> are applied <strong>in</strong> a nondiscrim<strong>in</strong><strong>at</strong>ory fashion on n<strong>at</strong>ional and foreign<br />

suppliers, but th<strong>at</strong> may nonetheless affect trade. This review will need to cover<br />

many issues (for example, see box 5.5). A wide range of government policies will<br />

need to be covered because of the central importance of distribution services to<br />

the domestic economy and to trade.<br />

An assessment needs to be carried out to identify government policies th<strong>at</strong> significantly<br />

affect the distribution sector either directly or <strong>in</strong>directly, particularly<br />

any regul<strong>at</strong>ions th<strong>at</strong> are unnecessarily trade restrictive and th<strong>at</strong> therefore should<br />

be modified. The direct impacts on the ownership of distribution enterprises and<br />

the capitaliz<strong>at</strong>ion and development of these enterprises must be considered first,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>in</strong>itial market access conditions, while the oper<strong>at</strong>ions of foreign companies<br />

th<strong>at</strong> have been permitted to establish a commercial presence should be considered<br />

next. More generally, the effect on employment levels, the pace of liberaliz<strong>at</strong>ion,<br />

and the need to take account of ethnic makeup and the ethnic sensibilities<br />

Box 5.5: Regul<strong>at</strong>ory Reform <strong>in</strong> the Retail Sector<br />

A study by Boylaud and Nicoletti (2001) of regul<strong>at</strong>ory reforms <strong>in</strong> the retail sector <strong>in</strong><br />

OECD countries offers useful guidance th<strong>at</strong> is also relevant for develop<strong>in</strong>g-country<br />

policy makers. The restrictions on market access prevail<strong>in</strong>g <strong>in</strong> the distribution sector,<br />

many of which apply more widely to bus<strong>in</strong>esses, rel<strong>at</strong>e to the follow<strong>in</strong>g:<br />

• Initial registr<strong>at</strong>ion (trade registers th<strong>at</strong> can <strong>in</strong>volve the imposition of delays of up<br />

to a year)<br />

• Fit and proper person requirements for directors and managers<br />

• Licenses or permits for loc<strong>at</strong>ion, sit<strong>in</strong>g, and limits on surface area and<br />

geographical area<br />

• The loc<strong>at</strong>ion and surface area of commercial premises, town plann<strong>in</strong>g and zon<strong>in</strong>g,<br />

park<strong>in</strong>g areas, road access<br />

• Regul<strong>at</strong>ions on specific oper<strong>at</strong>ions and products and the range of goods<br />

permitted<br />

• Local monopolies for the sale of some products, <strong>in</strong>clud<strong>in</strong>g pharmaceuticals,<br />

tobacco, alcohol<br />

• Legal restrictions on the establishment of large outlets (quantit<strong>at</strong>ive limits),<br />

<strong>in</strong>clud<strong>in</strong>g the protection of small shops to provide local proximity services and<br />

endorsement by established retailers and local lobbies th<strong>at</strong> resist foreign entrants<br />

through their membership <strong>in</strong> local authority plann<strong>in</strong>g committees
