the temporary crossborder movement of health personnel.<br />

• Bil<strong>at</strong>eral and regional free trade agreements: An <strong>in</strong>creas<strong>in</strong>g number of free<br />

trade agreements cover health services, such as the most recent Economic Partnership<br />

Agreement between the European Commission and the Caribbean<br />

region. 6<br />

• Bil<strong>at</strong>eral <strong>in</strong>vestment tre<strong>at</strong>ies: This mushroom<strong>in</strong>g c<strong>at</strong>egory of agreements could<br />

also be directly relevant to the trade <strong>in</strong> health services under Mode 3.<br />

The conclusion of a bil<strong>at</strong>eral or regional trade agreement is not a guarantee of liberaliz<strong>at</strong>ion<br />

or deeper market access <strong>in</strong> partner countries. The flexibility th<strong>at</strong> has<br />

led to the success of these agreements also constitutes their weakness because a<br />

number of exceptions could be carved out <strong>in</strong> each sector th<strong>at</strong> potentially nullify or<br />

impair the general commitments of the partners. The level of implement<strong>at</strong>ion of<br />

the agreements also varies significantly from case to case. The example of the<br />

Morocco–United St<strong>at</strong>es free trade agreement <strong>in</strong> table 4.9 illustr<strong>at</strong>es how health<br />

services could be subject to many more exceptions than other service sectors. It is<br />

often the case th<strong>at</strong> health is excluded from bil<strong>at</strong>eral or regional negoti<strong>at</strong>ions, such<br />

as <strong>in</strong> the context of the Union for the Mediterranean (the Euro-Mediterranean<br />

Partnership).<br />

In addition to these st<strong>at</strong>e-to-st<strong>at</strong>e agreements, a number of arrangements th<strong>at</strong><br />

also facilit<strong>at</strong>e trade could be concluded between public and priv<strong>at</strong>e <strong>in</strong>stitutions or<br />

among priv<strong>at</strong>e <strong>in</strong>stitutions. Typically, hospitals or universities conclude tw<strong>in</strong>n<strong>in</strong>g<br />

agreements with counterparts abroad th<strong>at</strong> <strong>in</strong>clude provisions on the exchange of<br />

health personnel for tra<strong>in</strong><strong>in</strong>g or educ<strong>at</strong>ion purposes. Depend<strong>in</strong>g on the public<br />

authority deleg<strong>at</strong>ed to them, professional associ<strong>at</strong>ions <strong>in</strong> the medical profession<br />

can also agree on the mutual recognition of diplomas and qualific<strong>at</strong>ions with foreign<br />

counterparts. The <strong>in</strong>volvement of priv<strong>at</strong>e <strong>in</strong>surance networks <strong>in</strong> health <strong>in</strong>surance<br />

conventions could help remove the ultim<strong>at</strong>e obstacle to trade <strong>in</strong> health services:<br />

the absence of health <strong>in</strong>surance portability.<br />

F<strong>in</strong>ally, regional cooper<strong>at</strong>ion is a potential solution to some health care shortages<br />

and can mitig<strong>at</strong>e some of the risks associ<strong>at</strong>ed with <strong>in</strong>creased trade. For<br />

<strong>in</strong>stance, the development of health centers of excellence <strong>in</strong> Africa could help<br />

neighbor<strong>in</strong>g countries share the cost of medical educ<strong>at</strong>ion and <strong>in</strong>frastructure<br />

<strong>in</strong>vestment.<br />

Multil<strong>at</strong>eral <strong>in</strong>iti<strong>at</strong>ives and agreements<br />

A vast liter<strong>at</strong>ure exists on health services, the GATS, and multil<strong>at</strong>eral trade negoti<strong>at</strong>ions.<br />

It is not the purpose of this chapter to analyze the GATS provisions perta<strong>in</strong><strong>in</strong>g<br />

to health or the World Health Organiz<strong>at</strong>ion (see Blou<strong>in</strong>, Drager, and
