of services th<strong>at</strong> large-scale clients demand. Indeed, trade <strong>in</strong> legal services is frequently<br />

undertaken through various forms of cooper<strong>at</strong>ion between law firms of<br />

different n<strong>at</strong>ional orig<strong>in</strong>s.<br />

Legal process outsourc<strong>in</strong>g, th<strong>at</strong> is, the crossborder supply of fragments of the<br />

legal services value cha<strong>in</strong>, is currently still rel<strong>at</strong>ively limited <strong>in</strong> magnitude. But<br />

analysts expect th<strong>at</strong> activities, such as document edit<strong>in</strong>g and proofread<strong>in</strong>g, litig<strong>at</strong>ion<br />

research, and <strong>in</strong>tellectual property work, will expand, so th<strong>at</strong> legal outsourc<strong>in</strong>g<br />

could become a significant export <strong>in</strong>dustry <strong>in</strong> com<strong>in</strong>g years. Low-<strong>in</strong>come<br />

countries th<strong>at</strong> can offer a comb<strong>in</strong><strong>at</strong>ion of reliable <strong>in</strong>form<strong>at</strong>ion and communic<strong>at</strong>ion<br />

technology <strong>in</strong>frastructure and the required legal expertise will have occasion<br />

to tap <strong>in</strong>to these bus<strong>in</strong>ess opportunities.<br />

Arguably, for development, imports of legal services are as important as<br />

exports. Countries have much to ga<strong>in</strong> from open<strong>in</strong>g their domestic legal markets<br />

to foreign service providers. While regul<strong>at</strong>ion of the legal profession to ensure<br />

consumer protection aga<strong>in</strong>st deceitful practices is necessary, regul<strong>at</strong>ion should<br />

not be more restrictive than needed. It should also avoid discrim<strong>in</strong><strong>at</strong><strong>in</strong>g among<br />

domestic and foreign service providers. Unfortun<strong>at</strong>ely, however, the regul<strong>at</strong>ory<br />

process, which often <strong>in</strong>volves self-regul<strong>at</strong>ion through the legal profession itself,<br />

may lend itself to be<strong>in</strong>g hijacked for protectionist purposes. In this context,<br />

periodic assessment of the regul<strong>at</strong>ory framework with a view to establish<strong>in</strong>g procompetitive<br />

practices is often desirable.<br />

Moreover, policy makers have an active role to play <strong>in</strong> the area of educ<strong>at</strong>ion<br />

and tra<strong>in</strong><strong>in</strong>g. They can, notably, work to raise educ<strong>at</strong>ional standards <strong>in</strong> colleges of<br />

law. They can also contribute to the development of the legal sector by design<strong>in</strong>g a
