Expansion of Sick Leave Benefits<br />

The <strong>Minnesota</strong> legislature recently passed a law which expands employees’ entitlement to use<br />

accrued sick leave benefits. Effective August 1, 2013, state employees may use paid sick leave<br />

for reasonable periods of time as the employee’s attendance may be necessary due to the illness<br />

or injury of the following family members:<br />

Brother or Sister<br />

Stepparent<br />

Grandparent<br />

The new law expands prior law that allowed for the use of sick leave for the illness or injury of an<br />

employee’s “child” (including stepchild and biological, adopted and foster child). Along with the<br />

expansion to include additional family members, this law does not require that these persons live in<br />

the employee’s household.<br />

An employer may limit the use of personal sick leave for the illness or injury of the employee’s:<br />

adult child; spouse not living in household; brother or sister; parent or stepparent not living in<br />

household; or grandparent to a cap of 160 hours in any 12-month period.<br />

The new law is an expansion of what is currently found in the sick leave article of the labor<br />

contracts and Plans. You are to apply the expanded provisions of the law, as well as the sick<br />

leave provisions of the applicable contract/Plan.<br />
