This group shall be comprised of up to eight (8) members each from <strong>AFSCME</strong> and from Mn/DOT.<br />

This group will be co-chaired by the <strong>AFSCME</strong> Business Representative and the Mn/DOT Labor<br />

Relations Manager. Minutes from meetings will be distributed to all Mn/DOT managers as well as<br />

all <strong>AFSCME</strong> Mn/DOT locals.<br />

This group will meet at least quarterly and as frequently as monthly upon mutual agreement and as<br />

agenda items warrant. Mn/DOT Labor Relations will provide staff support to the group.<br />

Section 3. Department-wide Transportation Specialist Series (TSS) Review Committee. The<br />

Committee shall be comprised of the following members:<br />

Mn/DOT Labor Relations Manager and two (2) other management representatives.<br />

<strong>AFSCME</strong> Council 5 Business Representative and two (2) other <strong>AFSCME</strong> representatives.<br />

The Committee will meet monthly or at a frequency as determined by the members.<br />

The Committee will be responsible for reviewing all grievances (excluding Article 16 - Discipline<br />

grievances and Article 12 Section 10F Non-certification) involving employees in the Transportation<br />

Specialist Series and Heavy Equipment Mechanics/Heavy Equipment Field Mechanics job<br />

classifications that are not resolved by the second step of the grievance process. The Committee<br />

will attempt to reach consensus on a resolution to the grievances and respond back to the location<br />

generating the grievance within ten (10) days or as agreed upon by the Committee. When<br />

consensus by the Committee is reached, the grievance will be considered resolved. The<br />

Committee will provide information on the resolution of grievances to all Mn/DOT locations to<br />

provide guidance and consistency in handling similar issues. Grievances not resolved at the<br />

Committee level will be considered denied at the third step of the grievance process and will be<br />

subject to the terms of Article 17 of the Master Agreement.<br />

The Committee will also be responsible for considering and responding to issues surrounding the<br />

Transportation Specialist Series and Heavy Equipment Mechanics/Heavy Equipment Field<br />

Mechanics that are not subject to the grievance procedure, and are unresolved or unanswered at<br />

the local level. The Committee may respond to these issues and/or refer them to the Departmentwide<br />

Labor <strong>Management</strong> Committee. Job classification issues shall not be subject to the<br />

grievance procedure or the review committee.<br />

Article 2<br />

Seniority<br />

Class seniority for each of the Transportation Specialist Series classes will include all time served<br />

in any Transportation Specialist Series class including: Highway Maintenance Worker, Highway<br />

Maintenance Worker Senior, Bridge Worker, Highway Technician, Highway Technician<br />

Intermediate, Highway Technician Senior, and Highway Helper (provided that any employee<br />

currently in this classification has also previously served in one of the above listed classes). Also<br />

included are any employees who have served in previous related classes, including but not limited<br />

to: Freeway Maintenance Man, Engineering Aide, Traffic Recorder, Transportation Sign<br />

Fabricator, Permanent HEO Operator, Highway Field Assistant and Transportation Aide.<br />

Article 3<br />

Position-Qualified<br />

The provisions of Article 12 and Article 15 of the Master Agreement shall be supplemented and/or<br />

modified as follows:<br />
