Section 6. Transfer to Another Appointing Authority. An employee who transfers or is<br />

transferred to another Appointing Authority without an interruption in service shall carry forward<br />

accrued and unused sick leave.<br />

ARTICLE 10 - LEAVES OF ABSENCE<br />

Section 1. Application for Leave. All requests for leaves of absence or extensions thereof shall<br />

be submitted in writing by the employee to the employee's immediate supervisor as soon as the<br />

need for such leave or extension is known. Extension may be requested orally with prompt written<br />

confirmation when the need for the submission is not known in time for a written request. The<br />

request shall state the reason for and the anticipated duration of the leave of absence.<br />

Section 2. Authorization for Leave. Authorization for or denial of a leave of absence shall be<br />

furnished to the employee in writing by the supervisor. All requests for a leave of absence shall be<br />

answered by the supervisor promptly, including, upon request by the employee, a statement of the<br />

Appointing Authority's intent regarding whether or not the employee's position will be filled<br />

permanently. No leave of absence request shall be unreasonably denied and no employee shall<br />

be required to exhaust vacation leave accruals prior to a leave of absence except as required<br />

under Section 4F, Personal Leave.<br />

When the Appointing Authority approves an unpaid leave of absence for an employee, the<br />

Appointing Authority shall advise the employee in writing of the steps the employee must take to<br />

continue insurance coverages.<br />

When more than one (1) employee requests a discretionary leave and the Appointing Authority<br />

determines that a discretionary leave or leaves may be granted, such leave or leaves shall be<br />

granted on the basis of State Seniority to the most senior employee making such request, provided<br />

the Appointing Authority may deny such request of a senior employee(s) if the Appointing Authority<br />

determines that the senior employee(s) has special skills or knowledge that are needed to function<br />

properly and efficiently. No employee shall be permitted to exercise seniority more than once in<br />

any five (5) year period to receive priority consideration for a discretionary leave of absence.<br />

However, this restriction on the use of seniority would not preclude the employee from being<br />

granted additional leaves of absence where seniority for such leave is not an issue. The<br />

Appointing Authority reserves the right at any time to deny or limit the number of discretionary<br />

leaves as provided above.<br />

Section 3. Paid Leaves of Absence. Paid leaves of absences granted under this Article shall not<br />

exceed the employee's normal work schedule.<br />

A. Bereavement Leave. The use of a reasonable period of sick leave shall be granted in cases<br />

of death of the spouse, the domestic partner (same and opposite sex), or parents and<br />

grandparents of the spouse, or the parents/step-parents, grandparents, guardian, children,<br />

grandchildren, brothers, sisters, wards, or stepchildren of the employee. In addition,<br />

bereavement leave limited to one (1) regularly scheduled shift shall be granted in the case of<br />

the death of the parent of the employee’s minor child.<br />

Time off to attend the funeral of individuals not listed above shall be charged against vacation<br />

leave if the employee's supervisor has approved the time off and such approval shall not result<br />

in any additional costs.<br />

The supervisor shall make a reasonable effort to adjust the hours of an employee in order to<br />

permit his/her attendance at the funeral of a co-worker.<br />
