Benefits<br />

A. Eligibility.<br />

Holidays, Vacation Leave, Sick Leave. Seasonal employees of the Department of Revenue<br />

shall become eligible to begin receiving the benefits provided by Article 7 (Holidays), Article 8<br />

(Vacation Leave), and Article 9 (Sick Leave) of the Master Agreement as follows:<br />

1. Effective upon ratification of the 2001-2003 Agreement, seasonal employees shall be<br />

eligible to receive holidays as provided by Article 7, Holidays, at date of hire. Seasonal<br />

employees who are working, or on seasonal layoff, and who have not yet completed six (6)<br />

months of actual work as a seasonal employee, shall also become eligible to receive<br />

holidays immediately upon ratification.<br />

2. Effective upon ratification of the 2001-2003 Agreement, seasonal employees shall become<br />

eligible to accrue vacation leave as provided in Article 8, Vacation Leave, at date of hire.<br />

Seasonal employees may not use vacation until completing six (6) months of actual work as<br />

a seasonal employee in one or more consecutive seasons. Seasonal employees who are<br />

working, or on seasonal layoff, and who have not yet completed six (6) months of actual<br />

work as a seasonal employee, shall be eligible to begin accruing vacation leave<br />

immediately upon ratification, but may not use vacation leave until they have completed six<br />

(6) months of actual work as a seasonal employee since their date of hire.<br />

3. Effective upon ratification of the 2003-2005 Agreement, seasonal employees shall become<br />

eligible to accrue sick leave as provided by Article 9, Sick Leave, at date of hire, however,<br />

seasonal employees may not use sick leave until completing six (6) months of actual work<br />

as a seasonal employee in one or more consecutive seasons. Seasonal employees who<br />

are working, or on seasonal layoff, and who have not yet completed six (6) months of actual<br />

work as a seasonal employee, shall be eligible to begin accruing sick leave immediately<br />

upon ratification, but may not use sick leave until they have completed six (6) months of<br />

actual work as a seasonal employee since their date of hire.<br />

Length of service for purposes of determining changes in accrual rates for employees who<br />

become eligible after July 1, 1985, shall begin on the date of eligibility. Effective July 1,<br />

1985, length of service for purposes of determining accrual rates for employees eligible for<br />

vacation time on or before July 1, 1985, shall include all actual time worked prior to July 1,<br />

1985, provided work is in consecutive seasons.<br />

To be entitled to receive paid holidays, an eligible employee must be in payroll status on the<br />

normal work day immediately preceding and the normal work day immediately following the<br />

holiday(s).<br />

Current employees of the State who accept seasonal employment with the Department of<br />

Revenue after December 1, 1988 without a break in service who are eligible for vacation,<br />

sick leave and holiday benefits shall continue to be eligible to use and earn such benefits in<br />

accordance with Master Agreement language based upon their length of service credit at<br />

the time of appointment to the seasonal position.<br />

B. Vacation Liquidation. If the Appointing Authority determines that liquidation of accumulated<br />

but unused vacation will not occur in a particular calendar year, employees and the local union<br />

will be notified by April 15. If the Appointing Authority chooses to liquidate, all accumulated but<br />

unused vacation hours in excess of one hundred twenty (120) hours will be liquidated once per<br />

calendar year at the time of seasonal layoff from the employee’s primary season.<br />
