An employee must meet the required qualifications for the specific position/vacancy to be<br />

considered for the position/vacancy in the Transportation Specialist Series or to exercise layoff<br />

options or recall rights to any position in the Transportation Specialist Series.<br />

Under Article 15 of the Master Agreement, employees in the Transportation Specialist Series shall<br />

be considered eligible to bump into lower Transportation Specialist Series classes, that they have<br />

not previously served, only within their seniority unit.<br />

For the purpose of position qualifications, “qualified” means the employee has the job related<br />

knowledge, skills, abilities, licensure and certifications required for appointment to the position and<br />

necessary for satisfactory performance of the job. These requirements will be determined by the<br />

Department.<br />

Article 4<br />

Hours of Work<br />

Article 5 of the Master Agreement shall be supplemented and/or modified as follows:<br />

1. Work Schedules. In the Department of Transportation, the Appointing Authority may change<br />

the daily starting and quitting time of Unit 2 and Unit 7 employees for the entire week up to two<br />

(2) hours either way providing a notice is posted a minimum of three (3) working days in<br />

advance of the proposed change. Notification prior to the start of any shift shall constitute the<br />

first day's notice. Employees may be returned to their previously established schedule upon<br />

reasonable notice by the Appointing Authority.<br />

2. Changed Work Schedules. Employees whose schedules are changed without a five (5) day<br />

notice and who are not required to work their original (posted) schedule or assigned available<br />

work, may use accrued vacation or compensatory time to fill in the remainder of their original<br />

(posted) schedule. This provision does not apply to winter maintenance schedules or<br />

contractors’ operations.<br />

3. <strong>Contract</strong>or Hours. Employees whose hours of work are controlled by the contractor may have<br />

their schedule changed due to the contractor's operations. In the event a change in schedule<br />

is necessary, as much advance notice as possible must be given the employee through the<br />

Appointing Authority's project supervisor. Such change shall not be considered a split shift.<br />

Any schedule changes made pursuant to the above shall not result in the payment of overtime.<br />

The supervisor shall give due consideration to any employee who requests not to work beyond<br />

sixteen (16) hours in a day. Normally, an employee shall not be required to work beyond<br />

fourteen (14) consecutive days. In this situation, the employee may request time off with three<br />

(3) days notice to the supervisor.<br />

4. Winter Maintenance Schedules. The Appointing Authority may establish a winter<br />

maintenance schedule to be used in severe or extreme road conditions for snow and ice<br />

control operations. The schedule shall be posted at least fourteen (14) calendar days in<br />

advance of the effective date each fall. The posted schedule shall also cite the date each<br />

spring when winter maintenance schedules shall no longer be in effect.<br />

Under the winter maintenance schedule, the Appointing Authority may split the available<br />

employees into more than one (1) shift. Such shift shall be periodically rotated or established<br />

by internal bid after taking into consideration the desires of the Local Union. The posting shall<br />

name which employees are assigned to each shift.<br />
