Section 2. Fixed Night Shift. The night shift shall be fixed and vacancies in such fixed shift shall<br />

be posted. If there are no eligible bidders for fixed night shift vacancies, the Appointing Authority<br />

shall fill the vacancy pursuant to Article 12, Section 7 or may request volunteers from among<br />

Capitol Security employees not on fixed nights. If one or more employees volunteer for the<br />

reassignment, the most senior volunteer, based on Class Seniority, shall be reassigned to the<br />

vacancy. If there are no volunteers, the least senior employee, based on Class Seniority not on<br />

fixed nights, shall be reassigned to the vacancy.<br />

Employees permanently assigned to a fixed night shift may be temporarily scheduled to work other<br />

shifts for the purpose of training, staff development, information meetings, or jury duty.<br />

Employees working other than fixed night shifts may be temporarily rescheduled to work the night<br />

shift. If it is necessary to make such a reassignment, the Appointing Authority shall request<br />

volunteers from among employees who are working other than fixed nights. If one or more<br />

employees volunteer for the reassignment, the most senior volunteer based on Class Seniority,<br />

shall be scheduled to work the night shift. If there are no volunteers, the least senior, based on<br />

Class Seniority, shall be scheduled to work the night shift.<br />

Article 5 of the Master Agreement shall be supplemented and/or modified as follows:<br />

Section 1. Alternate Work Schedules.<br />

Alternate Work Schedules<br />

A. Purpose. The purpose of this Article is to establish a voluntary alternate work schedule for all<br />

employees in the Department of Public Safety. Each DPS Division or Section has the option of<br />

implementing this program. For purposes of this Article, the work week shall be Wednesday<br />

through Tuesday.<br />

B. Alternate Work Schedule Request. The alternate work schedule shall allow an employee to<br />

request modification of his/her current work schedule to the following schedule: scheduled to work<br />

nine (9) consecutive hours four (4) days per week and scheduled to work one (1) four (4) hour day<br />

per week as designated by the Appointing Authority. Consecutive hours of work shall exclude the<br />

normal unpaid lunch period. The employee shall request participation in this program in writing to<br />

his/her immediate supervisor no later than seven (7) days prior to the starting date of the program.<br />

Once the program is in effect, an employee may request to revert back to his/her original schedule<br />

by providing a fourteen (14) calendar day notice to his/her immediate supervisor. Changes can<br />

only be made at the beginning of the work week.<br />

The Employer retains the right to deny individual requests under this program, and with fourteen<br />

(14) calendar days notice, to end an individual's participation in the alternate scheduling program<br />

where it would adversely affect the operation of the group. The Employer's decision in this regard<br />

is not subject to the grievance procedure in Article 17 of the Master Agreement. An employee may<br />

appeal their supervisor's decision in this regard to his/her Division Head or designee. If it is<br />

necessary to limit the number of participants within a group, the Employer shall approve the<br />

request(s) from the employee(s) with the most Department Seniority within the group.<br />
