Section 8. Resignations. An employee shall have the right to withdraw a written resignation<br />

within three (3) calendar days of its submission.<br />

ARTICLE 17 - GRIEVANCE PROCEDURE<br />

Section 1. Grievance Procedure. A grievance is defined as a dispute or disagreement as to the<br />

interpretation or application of any term or terms of this Agreement.<br />

Employees are encouraged to attempt to resolve the occurrence of any grievance on an informal<br />

basis with the employee's immediate supervisor at the earliest opportunity. If the matter is not<br />

resolved by informal discussion, it shall be settled in accord with the following procedure.<br />

If an employee/former employee pursues an appeal procedure under M.S. 197.46 (or other<br />

applicable Veterans Preference law), the employee/former employee shall be precluded from<br />

making an appeal under the following grievance procedure.<br />

Section 2. Processing Grievances.<br />

A. Release-time. Union Representatives and the grievant, as specified in "B" below, shall be<br />

allowed a reasonable amount of time, without loss of pay, during working hours while on the<br />

Appointing Authority's premises to investigate or process grievances in steps 1 through 3.<br />

Union representatives and the grievant shall not leave work or disrupt departmental routine to<br />

discuss grievances without first requesting permission from his/her immediate supervisor,<br />

which shall not be unreasonably withheld.<br />

B. Representatives.<br />

Step 1:<br />

Steps 2 and 3:<br />

Up to two (2) of the following Union Representatives may participate: Union<br />

Steward, Chief Steward, Union President, Union Vice-President, with or<br />

without the grievant.<br />

Up to three (3) of the same Union Representatives may participate with or<br />

without the grievant. In addition, the Union Staff Representative may<br />

participate in Step 3.<br />

Upon agreement of the Union and the Employer, the Local Union Steward, Chief Steward,<br />

President, and Vice-President need not be from the same seniority unit or bargaining unit as<br />

the grieving employee.<br />

C. See Appendix K entitled "Appointing Authority/Designee's Duty to Furnish Information to<br />

Exclusive Representatives Regarding <strong>Contract</strong> Grievances."<br />

D. Steps.<br />

STEP 1: The designated Union Representative(s), with or without the employee, shall<br />

attempt to resolve the matter with the employee's immediate supervisor within<br />

twenty-one (21) calendar days after the employee, through the use of reasonable<br />

diligence, should have had knowledge of the first occurrence of the event giving rise<br />

to the grievance. The supervisor shall then attempt to resolve the matter and shall<br />

respond to the Union Representative within seven (7) calendar days.<br />
