F. Salary Over Maximum on Reallocation. If a position is reallocated or recompared to a class<br />

with a lower salary range maximum, and the salary of the employee exceeds the maximum of<br />

the new range, the employee shall be placed in the new class and shall retain his/her current<br />

salary. In addition, the employee shall receive any across-the-board wage increase as<br />

provided by this Agreement.<br />

G. Exception for Clerical Consolidation Transition. All employees who were converted to a<br />

new consolidated clerical class effective July 8, 1998, (or were reallocated or had a change of<br />

allocation to a consolidated clerical class between the dates of July 8, 1998, and June 30,<br />

1999), are eligible for across-the-board increases even if their salary is above the salary range<br />

maximum. This exception applies until the employee moves to a new classification.<br />

Section 7. Shift Differential. The shift differential for employees working on assigned shifts<br />

which begin before 6:00 A.M. or which end at or after 7:00 P.M. shall be sixty-five cents ($0.65) per<br />

hour for all hours worked on that shift. Such shift differential shall be in addition to the employee's<br />

regular rate of pay and shall be included in all payroll calculations, but shall not apply during<br />

periods of paid leave.<br />

Employees working the regular day schedule who are required to work overtime or who are called<br />

back to work for special projects shall not be eligible for the shift differential.<br />

Section 8. Work Out of Class. When an employee is expressly assigned to perform substantially<br />

all of the duties of a position allocated to a different class that is temporarily unoccupied and the<br />

work-out-of-class assignment exceeds ten (10) consecutive work days in duration, the employee<br />

shall be paid for all such hours at the employee's current salary when assigned to work in a class<br />

which is a transfer or demotion. For a class which is a promotion, an employee shall receive an<br />

increase to the minimum rate of the new class or at least one (1) step higher than the employee's<br />

current salary, whichever is greater.<br />

If an employee is assigned to work out of class but does not meet the ten (10) consecutive work<br />

day standard, and within five (5) working days the employee is subsequently assigned to work out<br />

of class to the same assignment, the previous time served on work out of class will count towards<br />

meeting the ten (10) consecutive work day standard.<br />

When an employee is assigned to serve in a class for which the employee is on a layoff list, the<br />

employee shall be paid as provided above or the maximum step previously achieved by the<br />

employee, whichever is greater.<br />

If the Appointing Authority determines to make a work-out-of-class assignment of six (6) or more<br />

consecutive months to a higher class represented by the Union, the Appointing Authority shall<br />

appoint the most senior capable and available employee among or within classes and among or<br />

within work areas as determined by the Appointing Authority.<br />

Section 9. Severance Pay. All employees who have accrued twenty (20) years or more<br />

continuous State service shall receive severance pay upon any separation from State service<br />

except for discharge for cause. Employees with less than twenty (20) years continuous State<br />

service shall receive severance pay upon retirement at or after age 65; death; or layoff, except for<br />

seasonal layoffs. Employees who retire from State service after ten (10) years of continuous State<br />

service and who are immediately entitled at the time of retirement to receive an annuity under a<br />

State retirement program shall, notwithstanding an election to defer payment of the annuity, also<br />

receive severance pay.<br />
