you will receive shift differential for eligible hours accepted and worked under the Work<br />

Partnership Program.<br />

Inside fourteen (14) days, when the supervisor needs additional staff, (s)he:<br />

1. will decide which classification is needed;<br />

2. will offer the hours to all capable and qualified employees in the site (most State Seniority to<br />

least) until the need is met;<br />

3. may offer hours to capable and qualified employees in the chosen class outside the site who<br />

are on the roster for additional hours.<br />

4. Partnership employees may be offered overtime hours in sites outside of their assigned work<br />

area after the following conditions are met:<br />

a. all other employees assigned to the work area were first offered and turned down the<br />

overtime hours (including holidays);<br />

b. all overtime hours worked under the Partnership Program will be paid in cash.<br />

The maximum number may be increased or decreased with the written approval of the Local Union<br />

and Appointing Authority. For the purposes of layoff, variable schedule employees will be<br />

considered a separate employment condition.<br />

All position postings shall clearly state job duties, variable schedule and insurance eligibility<br />

conditions. The loss of insurance coverage will not invoke DHS or Master Agreement layoff<br />

language. Loss of eligibility and/or changes in contribution levels shall apply to the individual<br />

directly affected by such change.<br />

Variable schedule employees will be offered and must average a minimum of 1044 hours in twelve<br />

(12) consecutive months to maintain insurance eligibility under Article 19 of the Master Agreement.<br />

Variable Schedule employees will be scheduled for a portion of their time. However, additional<br />

hours may be assigned within the posting period. Additional hours and schedule changes within<br />

the posting period will be treated as a posted schedule and will not result in penalty pay. Every<br />

reasonable effort shall be made to schedule and assign work to variable schedule employees on<br />

an equal distribution basis.<br />

Variable schedule employees will be notified thirty (30) days in advance of the end of his/her<br />

twelve consecutive months if he/she may lose their coverage so the employee can make<br />

alternative plans. The Appointing Authority will review and adjust insurance contributions between<br />

full and partial levels on a quarterly basis.<br />

Variable schedule employees will be scheduled for a minimum of four (4) days off in a two (2) week<br />

period. At least two (2) of the days shall be consecutive. They can refuse additional hours within<br />

the posted schedule three (3) times per quarter. The fourth refusal or consistent unavailability<br />

when contacted for additional hours in a quarter may result in disciplinary action.<br />
