Section 7. Appeals. An employee may appeal in writing the decision of the immediate supervisor<br />

to deny or revoke a flex-time schedule to the Unit Manager who shall respond in writing. If not<br />

resolved at that level, the decision may be appealed in writing to the Assistant Director or Director<br />

as appropriate who shall respond in writing. The decision of the Assistant Director or Director is<br />

final and shall not be subject to Article 17 of the Master Agreement unless the action giving rise to<br />

the appeal is a violation of a specific provision of that Agreement.<br />

Section 8. Duration. This Supplemental Agreement shall be in effect for an indefinite period<br />

beginning the effective date of the Agreement. Should problems occur with this Agreement after<br />

its effective implementation date, the parties agree to meet and confer in an effort to resolve any<br />

issues may arise.<br />

Article 2<br />

Overtime<br />

Article 6 of the Master Agreement shall be supplemented and/or modified as follows:<br />

The Employer will make every effort to assign overtime as soon as practical once the need for<br />

overtime is known.<br />

DEPARTMENT OF MILITARY AFFAIRS<br />

Article 1<br />

Work Out of Class<br />

Article 18, Section 7, of the Master Agreement shall be supplemented and/or modified as follows<br />

for Duluth Airfield Firefighters:<br />

When an employee is expressly assigned to perform substantially all of the duties of a position<br />

allocated to a different class that is temporarily unoccupied and the work out of class assignment is<br />

at least one (1) twenty-four- (24) hour shift in duration, the employee shall be paid for all such<br />

hours at the employee's current salary when assigned to work in a lower or equal class or at a rate<br />

within a higher range which is equal to the minimum rate for the higher class or one (1) step higher<br />

than the employee's current salary, whichever is greater. When an employee is assigned to serve<br />

in a class for which the employee is on a layoff list, the employee shall be paid as provided above<br />

or the maximum step previously achieved by the employee, whichever is greater. If the Appointing<br />

Authority determines to make a work out of class assignment of six (6) or more consecutive<br />

months to a higher class represented by the Union, the Appointing Authority shall appoint the most<br />

senior capable and available employee among or within classes and among or within work areas<br />

as determined by the Appointing Authority.<br />

Article 2<br />

Holidays<br />

Article 7, Section 2 of the Master Agreement shall be supplemented and/or modified as follows:<br />

The provisions of Article 7, Section 2A and 2B shall not apply to Duluth Airfield Firefighters.<br />

The provisions of Article 7, Section 2C shall be supplemented and/or modified as follows:<br />

Duluth Airfield Firefighters shall receive two (2) floating holidays per fiscal year. Floating holidays<br />

may not be accumulated and shall not be paid in cash if not used. The rest of this section shall<br />

continue to be applied.<br />
