3. The employees' geographic areas of job responsibility shall remain their assigned bus or patrol<br />

districts, irrespective of the use of <strong>Minnesota</strong> State Patrol district offices and fixed scale sites<br />

and districts as the basis for determination of noon meal eligibility.<br />

Article 8<br />

Filling of Positions<br />

Section 1. The parties agree to meet and confer regarding issues about Lead Worker positions.<br />

Section 2. Only in the absence of the supervisor will lead workers covered by this bargaining<br />

agreement be allowed to authorize leave, sick leave slips or be required to take sick report calls<br />

from employees.<br />

LCR Reassignment<br />

Article 12, Section 4 and 5 shall be amended and/or modified to allow for the following:<br />

The Appointing Authority may assign and reassign the most senior volunteer, who expresses an<br />

interest in writing, within the work area between shifts prior to posting of a vacancy in the<br />

classification Law Compliance Representative 2 within the State Patrol Division.<br />

Job Postings<br />

Whenever a vacancy occurs, the Appointing Authority shall post for a minimum of seven (7)<br />

calendar days, a description of the vacancy. These postings shall be made electronically in all<br />

areas that employees have email access. In those areas where employee do not have email<br />

access, vacancies shall continue to be posted on employee bulletin boards or through such<br />

procedures as are otherwise agreed upon between the Appointing Authority and the Union.<br />

Capitol Security<br />

Security Communications Systems Monitors<br />

If a promotion is to be made from an eligible list to fill a Security Communications Systems Monitor<br />

position, a special selection may first be made from among Capitol Security Guards within the<br />

Seniority Unit whose names appear on the eligible list for such a position and who express an<br />

interest in the position. If no Capitol Security Guards appear on the eligible list or the Employer<br />

does not select a Capitol Security Guard under such special selection option, selection shall be<br />

made in accordance with Article 12 of the Master Agreement.<br />

The Union shall have the right to challenge the selection of an employee other than the senior<br />

employee through the third step of the grievance procedure only. If the grievance is denied, the<br />

Union may request a review of the grievance by the Department of Public Safety Human<br />

Resources Director. The Human Resources Director’s decision shall be final and not subject to<br />

arbitration.<br />

Probationary Periods<br />

All Units<br />

The provisions of Article 12, Section 10C of the Master Agreement shall be supplemented and/or<br />

modified as follow:<br />

At the request of the Appointing Authority, the initial six (6) months probationary period of a new<br />

employee may be extended for a period not to exceed three (3) months upon the mutual<br />

agreement of the Union and the Appointing Authority. In the case of Radio Communication<br />

Operators, the extension may not exceed four (4) months upon the mutual agreement of the Union<br />

and the Appointing Authority.<br />
