Article 6<br />

Hours of Work<br />

The execution of this Supplemental Agreement hereby amends Section 2, Subdivision B (Work<br />

Day), and Subdivision C (Work Week, Work Period), of Article 5 of the Master Agreement so as to<br />

recognize the legitimacy of an eight and one-half (8 1/2) or nine (9) hour work day.<br />

It is further agreed that no additional paid rest period shall be provided to an employee working on<br />

a flex-time schedule.<br />

Article 7<br />

Appeals<br />

An employee may appeal in writing the decision of the immediate supervisor to deny or revoke a<br />

flex-time schedule to the Unit Manager who shall respond in writing. If not resolved at that level,<br />

the decision may be appealed in writing to the appropriate Assistant Director who shall respond in<br />

writing. The decision of the Assistant Director is final and shall not be subject to Article 17 of the<br />

Master Agreement unless the action giving rise to the appeal is a violation of a specific provision of<br />

that Agreement.<br />

Article 8<br />

Duration<br />

This Supplemental Agreement shall be in effect for an indefinite period beginning the effective date<br />

of the Agreement. Should problems occur with this Agreement after its effective implementation<br />

date, the parties agree to meet and confer in an effort to resolve the issues. If they meet and<br />

confer and cannot resolve the issues, MSRS reserves the right to terminate the program with<br />

fourteen (14) calendar days written notice to the Union.<br />

Article 9<br />

Modification<br />

Any modification to this Supplemental Agreement must be agreed to in writing by the parties.<br />

DEPARTMENT OF TRANSPORTATION<br />

Article 1<br />

Meet and Confer<br />

Section 1. Department-wide Labor <strong>Management</strong> Committee. The Appointing Authority and the<br />

Union shall meet and confer annually to discuss issues of mutual concern including new directions<br />

and/or changes being planned by the Appointing Authority. The Committee may meet as<br />

frequently as quarterly upon mutual agreement and as agenda items warrant. The Committee<br />

shall be comprised of seven (7) members each from the Appointing Authority and the Union.<br />

Section 2. Transportation Specialist Series (TSS) Committee. The purpose of this Committee<br />

will be to meet and confer to discuss issues of mutual concern related to operational directions or<br />

changes planned by Mn/DOT regarding work planning and workforce planning/strategic staffing.<br />

For example, discussions on maximizing the use of our TSS workforce have significant department<br />

resource implications. This Committee will provide a forum for mutual understanding of the current<br />

state of the workforce, including staffing directions, training opportunities/skill development,<br />

identification of other operational issues of mutual concern. Issues brought to resolution will be<br />

addressed for implementation by a meeting of the <strong>AFSCME</strong>, Council 5, liaison, the Mn/DOT Labor<br />

Relations Manager and the Operations Division Director (or the appropriate Division Director).<br />
