In the event, the notice of overtime occurs on First Watch and all nurses, who are off duty,<br />

decline the overtime the least senior qualified, capable and available off-duty LPN in the<br />

work unit will be notified they are assigned to work the overtime assignment.<br />

B. Conditions.<br />

1. No LPN shall be required to work overtime in the event vacation leave has been approved<br />

for the time of the overtime shift, however, the LPN would be eligible to volunteer for the<br />

overtime assignment. In the event that the LPN is notified that s/he is being forced to work<br />

overtime, the LPN shall inform the person assigning such overtime that s/he has approved<br />

vacation leave for the time of the overtime shift.<br />

2. An LPN working a voluntary overtime shift may not be mandated to work the subsequent<br />

shift if overtime coverage is necessary. However, the LPN may volunteer if the supervisor<br />

determines the LPN capable and qualified. In the event that the LPN is notified that s/he is<br />

being forced to work overtime, the LPN shall inform the person assigning such overtime<br />

that s/he is currently working a voluntary overtime shift.<br />

3. An LPN who prefers to not be contacted for overtime during scheduled days off or during<br />

periods of scheduled leave, shall submit a written request to the Nursing Supervisor.<br />

Overtime Distribution<br />

Article 6, Overtime, and the Department of Corrections Supplemental shall be supplemented<br />

and/or modified as follows:<br />

Physical Plant Snow Removal Overtime<br />

Groundskeepers will always be called in first for snow removal overtime as part of their duties. A<br />

snow removal overtime list will be established each year prior to the snow removal season for all<br />

other physical plant staff who wish to be contacted for such overtime. In the event additional staff<br />

are needed for snow removal, those staff who are on the snow removal list will be contacted in the<br />

order of State Seniority until a sufficient number of employees have been obtained for the overtime<br />

assignment. If the employee is not at home or an answering machine is contacted, no message<br />

will be left and a no answer for overtime will be assumed. All employees on this list will receive<br />

snow removal training.<br />

If an insufficient number of employees on the snow removal list are available for the snow removal<br />

overtime, the Appointing Authority shall have the right to assign overtime to the appropriate<br />

number of physical plant staff based upon inverse order of State Seniority. The Appointing<br />

Authority shall retain the right of approval of all employees volunteering or required to perform<br />

snow removal duties based upon the supervisor's determination of the employee's ability to<br />

perform all such duties.<br />
