DEPARTMENT OF AGRICULTURE<br />

Article 1<br />

The provisions of the Master Agreement shall be supplemented and/or modified as follows:<br />

Flextime Plan<br />

Schedule Requests<br />

The flextime plan shall allow an employee to request modification of his/her current work schedule<br />

to any schedule which includes forty (40) hours per work week. The normal work week is<br />

considered to run Wednesday through Tuesday; however, this period may be adjusted to a<br />

different seven- (7)-consecutive-day period by the placement of a memorandum in the employee’s<br />

personnel file. Consecutive hours of work shall exclude a thirty or sixty minute unpaid lunch<br />

period. A schedule must begin no earlier than 6:30 a.m. and end no later than 6:30 p.m. The<br />

employee shall request a modification in writing to his/her immediate supervisor no later than<br />

fourteen (14) calendar days prior to the date the requested schedule would go into effect, if<br />

approved. Changes in approved flextime schedules shall be made by management only in accord<br />

with the provisions of Article 5 of the Master Agreement. Employees may request changes in their<br />

approved work schedules by giving the Appointing Authority the notice contained above. Upon<br />

mutual agreement by the employee and Employer, the fourteen (14) day notice may be waived.<br />

Review of Requests<br />

The immediate supervisor shall determine to approve or deny the request of the employee within<br />

his/her work unit based upon job-related considerations. If there are conflicting requests from<br />

employees and the needs of the supervisor require that not all requests may be approved, the<br />

supervisor shall approve (if all other considerations indicate approval) the request submitted by the<br />

employee with the most state seniority. Should conflicts still exist, they shall be resolved by lot.<br />

The immediate supervisor shall provide the employee with written notice and explanation of the<br />

decision within seven (7) calendar days of receipt of the request. If an employee's request is<br />

denied, a copy of the written notice and explanation of the decision shall be available to the Union.<br />

No request shall be unreasonably denied.<br />

Altered Schedules<br />

Upon assignment of an employee to attend training sessions, other meetings, or a request by an<br />

employee and upon mutual agreement of the immediate supervisor and the employee, an<br />

employee's schedule may be temporarily altered for a duration of no more than fourteen (14)<br />

consecutive calendar days at a time without regard to the above provisions. These changes shall<br />

not result in payment of overtime.<br />

If requested by the employee, the employee may change days, shifts, or hours of work with the<br />

approval of his/her supervisor, provided such change does not result in the payment of overtime.<br />

These changes shall not result in the payment of overtime. Such changes shall not exceed the<br />

forty (40) hour work period (Wednesday through Tuesday). “Altered Work Schedule” shall be<br />

noted on the timesheet.<br />

Appeals<br />

An employee may appeal the decision of the immediate supervisor to deny or revoke a flextime<br />

schedule to the appropriate division director who shall respond in writing and, if not resolved at that<br />

level, to the Commissioner's designee who shall respond in writing. The decision of the<br />

Commissioner or his/her designee is final and shall not be subject to Article 17 of the Master<br />

Agreement.<br />
