Seasonal employees shall be recalled in the order of Classification Seniority (State Seniority for<br />

Unit 6) to the seniority unit, employment condition, and principal place of employment from which<br />

they were laid off, unless waived by mutual agreement between the employee and the Appointing<br />

Authority.<br />

Notice of Seasonal Layoff and Recall. Article 15, Section 4B and 4E of the Master Agreement<br />

shall be modified as follows:<br />

Employees may choose to receive notice of seasonal layoff and recall by electronic message with<br />

written notice to the Appointing Authority. It shall be the employee’s responsibility to keep the<br />

Appointing Authority informed of the employee’s current address.<br />

Article 3<br />

Temporary Employment<br />

The provisions of the Master Agreement Article 15, Section 5 shall be supplemented and/or<br />

modified as follows:<br />

A position to be filled by a temporary or emergency appointment, regardless of the source of the<br />

funding, shall be offered in the following order:<br />

1. Seasonal employees who have received a seasonal layoff notice and completed their season<br />

or who have completed a temporary project may bump any employee with less State Seniority<br />

from a temporary appointment which has an anticipated duration of at least thirty (30) calendar<br />

days from that employee's scheduled layoff date in the same discipline and principal place of<br />

employment for which the bumping employee has the ability and capacity to perform the work,<br />

as determined by the Appointing Authority;<br />

2. Employees who are permanently laid off and not employed by the State if the position is in the<br />

same class, seniority unit, and geographic area from which they were laid off in order of<br />

Classification Seniority;<br />

3. Employees who are permanently laid off and not employed by the State if the position is in the<br />

same seniority unit and geographic area from which they were laid off and the employee is<br />

determined to be qualified for the appointment by the Appointing Authority in the order of State<br />

Seniority;<br />

4. Seasonal employees in seasonal layoff status who have the ability and capacity, as determined<br />

by the Appointing Authority, to perform the work, in their principal place of employment and<br />

within their discipline on the basis of State Seniority;<br />

5. Seasonal employees in seasonal layoff status who have the ability and capacity, as determined<br />

by the Appointing Authority, to perform the work within the discipline and within fifty (50) miles<br />

of the principal place of employment on the basis of State Seniority. The employee may waive<br />

the temporary assignment. Where the time requirements of the temporary assignment are of<br />

an emergency nature and do not allow the selection of the employee in the above manner, the<br />

Appointing Authority is not required to select the employee.<br />

6. Seasonal employees in seasonal layoff status shall be permitted to make known their<br />

availability for temporary positions across disciplines at different Department of Natural<br />

Resources locations within fifty (50) miles of their principal place of employment. Employees<br />

shall notify in writing each office for which they are available for this temporary work. Such<br />

employees shall be considered for these positions in order of State Seniority provided the<br />

senior employee is qualified to perform the duties of the position, except where the temporary<br />

assignment is of an emergency nature.<br />
