Filling Positions Vacated by Layoff<br />

If the Appointing Authority determines to fill the position vacated by the employee who has<br />

received the layoff notice, the Appointing Authority shall have the option of requesting volunteers<br />

from among employees in the same class (or class option) and same employment condition and<br />

shift in the subdivision of the work location of the position to be eliminated, or may reassign the<br />

least senior qualified employee from the same class (or class option), employment condition and<br />

subdivision of the work location. However, if the Appointing Authority requires volunteers and one<br />

or more employees volunteer for reassignment, the most senior qualified volunteer shall be<br />

reassigned. If there are no volunteers, the Appointing Authority shall reassign the least senior<br />

qualified employee in the same class (or class option) and same employment condition and shift in<br />

the subdivision of the work location of the position to be eliminated to the position vacated by the<br />

noticed employee.<br />

Article 15, Section 3D of the Master Agreement shall be supplemented and/or modified as follows:<br />

An employee who is to be bumped a third time within a six (6) month period shall have the option<br />

to be laid off rather than accept a vacancy or bump another employee.<br />

Article 2<br />

Bidding From Layoff<br />

The provisions of the Master Agreement regarding bidding from layoff shall be supplemented<br />

and/or modified as follows:<br />

The Appointing Authority shall not consider a bid by an employee if acceptance of the bid would<br />

create a layoff or bumping situation nor accept a bid from an employee if acceptance of the bid<br />

would prevent the recall of a more senior employee from the Seniority Unit Layoff List laid off from<br />

the same class, employment condition, and location.<br />

Article 3<br />

Seasonal Employees<br />

The schedules of anticipated seasonal layoffs by work location shall be provided in a letter sent to<br />

the Union and posted in any work area where seasonal employees are working.<br />

Article 4<br />

Employee Lists<br />

Upon request, but not more than every six (6) months, the Appointing Authority shall provide the<br />

Local Union with the staff complement for each work area (alpha sort and location code sort).<br />
