Article 1<br />

Scheduling<br />

Article 5, Hours of Work of the Master Agreement shall be supplemented and/or modified as<br />

follows:<br />

1. Additional Hours. Part-time employees may be offered additional hours on a day not<br />

scheduled.<br />

The Administrator shall notify the affected employees as soon as the need for such schedule<br />

changes becomes known. An effort will be made to distribute available work hours subject to<br />

this change on an equal basis. In all cases, any change in scheduling shall be for additional<br />

work hours not previously scheduled and not to exceed eight (8) hours per shift at straight time<br />

pay, and must be due to unanticipated, unknown or unforeseen reasons. Any schedule<br />

changes made which meet this criteria shall not be subjected to penalty pay.<br />

2. Work Period. All employees shall be scheduled to work no more than seven (7) consecutive<br />

days. Any employee scheduled more than seven (7) consecutive days shall receive<br />

compensation for hours worked beyond seven (7) consecutive days at the rate of time and onehalf.<br />

However, when the seven (7) consecutive days are exceeded due to the employee<br />

trading shifts or agreeing to additional hours, the employee shall not receive penalty pay.<br />

3. Fixed Night Shift (for all units except Units 2 and 7). Where continuous operations require<br />

a night shift, such shift shall be fixed and vacancies in such fixed shifts shall be posted. If there<br />

are no eligible bidders for fixed night shift vacancies, the Administrator may recruit and hire<br />

applicants for the vacancy or assign the capable and qualified employee not on fixed nights<br />

with the least Classification Seniority to the vacancy.<br />

Employees permanently assigned to a fixed night shift shall have their weekends defined as<br />

Friday and Saturday.<br />

Employees permanently assigned to a fixed night shift may be scheduled to work other shifts<br />

for the purposes of training, staff development, informational meetings, projects or jury duty.<br />

Employees working other than fixed night shifts may be rescheduled to work the night shift.<br />

The Administrator shall determine the work area from which an employee is to be assigned to<br />

the night shift. If it is necessary to make such a reassignment, the least senior capable and<br />

qualified employee based on State Seniority within or among class(es) as determined by the<br />

Administrator from such work area who is working other than fixed nights shall be scheduled to<br />

work the night shift to:<br />

a. Cover night shift staffing shortages caused by leaves (paid or unpaid) of six (6) months or<br />

less of the employees normally assigned to the night shift; and/or,<br />

b. Cover night shift staffing shortages caused by assignment to other shifts of the employees<br />

normally assigned to the night shift; and/or,<br />

c. Cover night shift vacancies during the posting, bidding, and hiring procedures; and/or,<br />

d. Cover for days off of employees assigned to fixed nights.<br />

e. Emergency situations.<br />
