An employee who refuses a job and training opportunity not requiring relocation waives<br />

his/her right to enhanced separation. An employee who does not accept a job and training<br />

opportunity requiring relocation shall be entitled to select the enhanced separation option or<br />

normal separation.<br />

Employees who have not been offered a position within twelve (12) months of selecting the Job<br />

and Retraining Option shall be offered Option 2, Enhanced Separation or Option 3, Normal<br />

Separation.<br />

Employees who selected the Job and Retraining Option prior to August 1, 2005 shall have their<br />

twelve (12) month time frame begin effective the August 1, 2005 date.<br />

Section 4. Enhanced Separation Package.<br />

2.1 Retirement, with Employer paid insurance benefits; the employee shall continue to receive<br />

the Employer contribution toward health and dental insurance equal to one hundred percent<br />

(100%) of the current annual contribution for themselves and their enrolled dependents. DHS<br />

will absorb subsequent increases up to two hundred dollars ($200). Increases beyond two<br />

hundred dollars ($200) will be the employee’s responsibility; or<br />

2.2 In addition to benefits provided under collective bargaining agreements, a one-time enhanced<br />

payment not to exceed $20,000 and not to exceed $2,000 multiplied by the number of years<br />

of State service. For employees selecting this option, the department agrees not to contest<br />

any unemployment insurance determination; or,<br />

2.3 In lieu of the one-time enhanced payment, tuition, fees, books, travel expenses, career<br />

guidance, and related expenses at a public institution of post-secondary education, up to the<br />

amount of the enhanced payment to which the employee would be entitled.<br />

An employee electing the enhanced separation options waives his/her recall rights under the<br />

collective bargaining agreements.<br />

Section 5. Normal Separation Package.<br />

3.1 Normal separation, with all rights negotiated under collective bargaining agreements.<br />

Memorandum of Understanding - Implementation Procedures<br />

Section 1. Non-Eligible Employees:<br />

1. The following types of employees are not governed by any of the terms of the Memorandum of<br />

Understanding:<br />

a. part-time and full-time temporary employees, including student workers and temporary<br />

unclassified employees.<br />

b. part-time and full-time emergency employees.<br />

c. any permanent or probationary employee hired on or after August 1, 2005.<br />

d. intermittent employees. However, such employees are eligible for the layoff and recall<br />

provisions of the parties' Collective Bargaining Agreements except that the vacancy and<br />

bumping options shall not be available to the employees. Layoff and recall provisions<br />

include:<br />

1. cash out of any existing accumulated vacation balance.<br />
