39. Vacancies. Article 12, Section 7E of the Master Agreement shall be supplemented as follows:<br />

Whenever the Appointing Authority fills a vacancy at a University under Subsection D in the<br />

class Plant Maintenance Engineer or the class Stationary Engineer, the Appointing Authority<br />

agrees to notify employees in the Maintenance Department of the vacancy and to consider<br />

requests for voluntary transfers from the class Plant Maintenance Engineer to the class<br />

Stationary Engineer or from the class Stationary Engineer to the class Plant Maintenance<br />

Engineer before using the other options under Subsection D to fill the vacancy. All other<br />

provisions of Subsection D shall remain in effect.<br />

40. Hours of Work. Article 5, Section 1, Subsection C of the Master Agreement shall be modified<br />

as follows:<br />

For employees in the Maintenance Department of St. Cloud State University and Bemidji State<br />

University, one (1) Stationary Engineer position shall be the relief position. The relief position<br />

shall not be subject to the fourteen (14) calendar day requirement for posting of schedules<br />

when relieving for sick leave or for short periods of vacation when advance written approval<br />

has not been given. The work schedule for the relief position may be changed upon notification<br />

of eight (8) hours in advance of the start of the shift in the case of sick leave relief or upon<br />

notification of twenty four (24) hours in advance of the shift in the case of vacation relief without<br />

incurring overtime liability. All other provisions shall remain in effect. For Moorhead State<br />

University, the parties agree to meet and negotiate in good faith to resolve work schedule<br />

issues.<br />

41. Reduction in Hours. Article 5, Section 4 of the Master Agreement shall be supplemented<br />

and/or modified as follows:<br />

If it is necessary to reduce the hours of a full-time seasonal position referenced above such that<br />

the incumbent of the position is no longer eligible to receive the full Employer's insurance<br />

contribution or is no longer eligible to participate in the Employer's insurance program, the<br />

Appointing Authority shall request volunteers for the position from among employees in the<br />

same class, employment condition and work area. If one or more employees volunteer for the<br />

position, the most senior qualified volunteer shall be offered the position. If there are no<br />

volunteers, the least senior qualified employee in the same class, employment condition, and<br />

work area shall be assigned to the position.<br />

Part 5. Technical Colleges<br />

42. Definition of State Seniority. “State Seniority” shall be defined as the date of first<br />

employment with the Technical College or with a member school district from which the<br />

employee moved or was assigned to the joint technical college district or any other seniority<br />

recognized by the Technical College. It shall also include any time served in a temporary<br />

appointment where the employee was appointed to a permanent position in the same class<br />

without a break in service. “Break in service” shall not include academic year breaks.<br />

43. Definition of Class Seniority. “Class Seniority” in the employee's initial state classification<br />

shall be defined as the employee's State Seniority as defined above. A Technical College<br />

employee who is reallocated to a different classification within the College, transfers, demotes<br />

or promotes to another class or state agency after July 1, 1995, shall have class seniority in the<br />

new class determined in accordance with the Master Agreement. The preceding sentence<br />

does not apply to a Technical College employee who transfers in the same class to another<br />

Technical College.<br />
