5. In the event a summer program position in the class HST, SEPA, RPL or RPA becomes vacant<br />

at either the Academy for the Deaf or the Academy for the Blind, the Appointing Authority will<br />

first offer the position to employees who are on layoff from the Academy where the vacancy<br />

exists as outlined in this Section.<br />

6. If all eligible employees from the Academy where the vacancy exist have obtained summer<br />

program positions or have waived their right of recall, the summer program position shall next<br />

be offered to employees from the other Academy who were either: a) unable to obtain a<br />

summer program position; b) obtained a position in a lower classification because no position in<br />

their classification was available; or c) obtained a less than full-time position.<br />

Such positions shall be posted for three (3) working days and employees listed in a, b, or c,<br />

who desire to bid on these positions must submit such bids within these three (3) working days.<br />

On the second working day following the close of bidding, employees who have secured a<br />

summer program position shall receive notification which includes the summer program<br />

position they have obtained, the duties of summer program, and the date of recall for the<br />

beginning of the next academic year.<br />

If vacancies again become open at an Academy because employees have exercised rights<br />

above, these newly opened positions shall be posted for three (3) working days and employees<br />

in a, b or c above, who desire to bid on the newly-opened positions must submit such bids<br />

within these three (3) working days. On the second working day following the close of bidding,<br />

employees who have secured a summer program position shall receive notification which<br />

includes the summer program position they have obtained, the duties of summer program, and<br />

the date of recall for the beginning of the next academic year.<br />

In all cases the position shall be offered to employees in order of Classification Seniority for<br />

Units #2 and #3 and State Seniority for Units #4 and #6, provided the senior employee's ability<br />

and capacity to perform the job are relatively equal to that of the other bidders.<br />

When it is necessary to reduce numbers of staff, the reductions shall first be made from the<br />

employees who bid from the other Academy. Such employees shall return to their respective<br />

Academy and resume their previously awarded bid.<br />

7. Summer program bids will be awarded and vacant positions shall be filled by recall of laid off<br />

employees in Classification Seniority order for the classifications of Food Service Worker, Cook<br />

or Cook Coordinator and Dining Hall Coordinator, and in State Seniority order for the<br />

classifications of Licensed Practical Nurse I (LPN I) and Licensed Practical Nurse II (LPN II),<br />

who are currently appointed to or who have previously served in such classification. An<br />

employee must accept recall to his/her currently appointed class before accepting recall to a<br />

previously served in class.<br />

8. For purposes of this Supplemental Agreement only, Classification Seniority, upon recall, shall<br />

include Classification Seniority in all higher related or equally related paid classes in which the<br />

employee has served with the State of <strong>Minnesota</strong>.<br />

9. Employees accepting recall to classes in which they have previously served shall retain their<br />

present salary unless that salary exceeds the maximum rate of pay for the new position, in<br />

which case the employee's salary shall be adjusted to the new maximum.<br />

10. Vacation leave hours used by employees covered by this Supplemental Agreement to extend<br />

their work season shall be paid at the rate at which they are earned.<br />

11. Employees who bid on summer program positions and intend to use leave for periods of three<br />

(3) days or more, during the summer program session, are expected to request the use of<br />

leave at the time they submit their bids.<br />
