Article 10<br />

Pay Differentials<br />

A. Selection for Certification of Employees for Heavy Equipment Operator (Intermittent).<br />

When the Appointing Authority determines that an additional employee(s) is to be trained for<br />

certification to operate a piece of heavy equipment, such opportunity shall be posted at the<br />

principal place of employment for a minimum of seven (7) calendar days. Employees within the<br />

same discipline and assigned to the same principal place of employment who are interested in<br />

being considered for such training shall indicate their interest in writing.<br />

For each Heavy Equipment Operator (Intermittent) needed by the Appointing Authority in a<br />

principal place of employment and discipline, the Appointing Authority shall consider for training<br />

the three (3) most senior employees who have indicated their interest in writing.<br />

Such employees considered for training will be scheduled for an oral interview before a three<br />

(3) member panel of supervisors selected by the Appointing Authority for the purpose of<br />

determining their knowledge of the proper maintenance and the operation of the equipment.<br />

Each of the considered employees shall be scored individually by each supervisor and the<br />

scores of each of the three supervisors shall be totaled. The employee(s) with the highest total<br />

score shall be selected for the training. When additional certified operators are needed, over<br />

and above the number indicated by the posting, the entire process shall be repeated. The<br />

Local Union shall be provided fourteen (14) days written notice of the interview date. By mutual<br />

agreement of the Regional <strong>Management</strong> Resources Supervisor and the Local Union, the<br />

fourteen (14) day written notice of the interview date may be reduced or waived. During the<br />

selection process, a Union Representative shall be afforded the opportunity to be present for<br />

the purpose of observing the impartiality and fairness of the scoring process.<br />

When an additional certified operator(s) is needed, the entire process shall be repeated.<br />

B. Certification of Employees for Heavy Equipment Operator (Intermittent). An employee<br />

shall be certified as a Heavy Equipment Operator (Intermittent) upon completion of the<br />

minimum number of hours required for that designated piece of equipment or upon completion<br />

of two (2) years of training whichever comes first and upon certification by the immediate<br />

supervisor and the Regional <strong>Management</strong> Resources Supervisor that the employee has<br />

demonstrated his/her ability to satisfactorily operate and maintain the equipment.<br />

After certification, for good and sufficient reasons, the immediate supervisor and the Regional<br />

<strong>Management</strong> Resources Supervisor may re-review the capabilities of the employee to operate<br />

and maintain the equipment for continued certification.<br />

After certification, the immediate supervisor and Regional <strong>Management</strong> Resources Supervisor<br />

reserves the right to decertify Intermittent Heavy Equipment Operators whose performance<br />

deteriorates and who fail to meet the standards established by the supervisor for operating<br />

heavy equipment or who fail to maintain the equipment properly, or who abuse the equipment.<br />

Decertification shall be grievable under Article 17 of the Master Agreement.<br />

C. Assignment to Heavy Equipment Operator (Intermittent). Intermittent Heavy Equipment<br />

Operating assignments shall be made on the basis of State Seniority from among certified<br />

employees who are available and capable of performing the work in the same discipline and<br />

assigned to the same principal place of employment. Where no certified operators are<br />

available in the principal place of employment, the Appointing Authority may then select any<br />

other principal place of employment from which to assign an operator following the same<br />

procedure.<br />
