In proposito, si segnala, in primo luogo, l’art X-5:201 (Priority of rules of succession<br />

law) 430 che ha il pregio di chiarire il rapporto che l’istituzione del trust ha rispetto al<br />

diritto delle successioni ed in particolare, nell’ottica di un interprete italiano, con le<br />

norme sulla tutela delle aspettative dei legittimari.<br />

Con riferimento alla tutela del credito il progetto precisa, all’art. X-12:101, il regime di<br />

responsabilità dei beni conferiti nel trust, che risponderanno dei soli trust debt, ossia dei<br />

debiti che siano collegati oggettivamente con il trust, secondo i criteri indicati al<br />

successivo art. X – 12:102 431 .<br />

430 “Where the trust is to effect on the truster’s death, the trust is subject to the prior application of those<br />

rules of succession law which determine: (…)<br />

b) (i) whether the truster was free to dispose of the fund or any asset within the fund;<br />

(ii) Whether any person has a claim in respect of the fund take or assets within the fund,<br />

reason fo their family or other connection to the deceased, and<br />

(iii) How such claims are to be satisfied”<br />

431 X – 12: 102 (Definition of trust debt)<br />

(1) An obligation which binds the owner for the time being of an asset is a trust debt if that asset if<br />

that asset is a trust asset.<br />

(2) An obligation which a trustee incurs in the course of performing obligations under trust is a trust<br />

debt.<br />

(3) An obligation incurred by a trustee by a contract or other judicial act, but not in the course of<br />

performing obligations under the trust is a trust debt if:<br />

(a) the trustee acts in that capacity;<br />

(b) the juridical act is not gratuitous; and<br />

(c) the other party neither knows nor could reasonably be expected to know that the trustee is<br />

not incurring the obligation in the course of fulfilling an obligation under the trust,<br />

(4) An obligation incurred by a trustee otherwise than by a juridical act and not in the course of<br />

performing obligations under the trust debt if it is materially connected with:<br />

(a) the trust fund or a trust debt; or<br />

(b) an act or omission of the trustee in the administration or disposition of the trust fund; or<br />

(c) incurring or performing an obligation which is itself a trust debt.<br />

(5) The obligations of trustees to reimburse, indemnify or remunerate a former trustee or an<br />

intended trustee who has exercised a right of refusal are also trust debts.<br />

(6) Other obligations of a trustee are not trust debts.<br />
