II. Exam<strong>in</strong>ati<strong>on</strong>s and academic degrees<br />

In <strong>the</strong> case of degree exam<strong>in</strong>ati<strong>on</strong>s <strong>the</strong>re is a need to dist<strong>in</strong>guish between purely academic exam<strong>in</strong>ati<strong>on</strong>s<br />

(Hochschulprüfungen), State exam<strong>in</strong>ati<strong>on</strong>s (Staatsprüfungen) and, less often, ecclesiastical exam<strong>in</strong>ati<strong>on</strong>s (Kirchliche<br />

Prüfungen). The degrees <strong>the</strong>se exam<strong>in</strong>ati<strong>on</strong>s lead to generally c<strong>on</strong>stitute a professi<strong>on</strong>al qualificati<strong>on</strong>. There are <strong>the</strong> follow<strong>in</strong>g<br />

k<strong>in</strong>ds of academic exam<strong>in</strong>ati<strong>on</strong>s, all of which are c<strong>on</strong>nected with <strong>the</strong> c<strong>on</strong>ferr<strong>in</strong>g of an academic degree:<br />

<strong>the</strong> Diplom exam<strong>in</strong>ati<strong>on</strong> <strong>in</strong>volv<strong>in</strong>g <strong>the</strong> c<strong>on</strong>ferr<strong>in</strong>g of <strong>the</strong> Diplom degree (e.g. Diplom-Ingenieur, Diplom-Kaufmann); <strong>the</strong><br />

Diplom degrees c<strong>on</strong>ferred by Fachhochschulen are marked by an additi<strong>on</strong>al ‘FH’ <strong>in</strong> brackets;<br />

<strong>the</strong> Magister exam<strong>in</strong>ati<strong>on</strong> <strong>in</strong>volv<strong>in</strong>g <strong>the</strong> c<strong>on</strong>ferr<strong>in</strong>g of <strong>the</strong> Magister degree (e.g. Magister Artium);<br />

<strong>the</strong> Lizentiat exam<strong>in</strong>ati<strong>on</strong> <strong>in</strong>volv<strong>in</strong>g <strong>the</strong> c<strong>on</strong>ferr<strong>in</strong>g of <strong>the</strong> Lizentiat degree (e.g. Licentiatus <strong>the</strong>ologiae).<br />

The award<strong>in</strong>g of a degree is c<strong>on</strong>nected with <strong>the</strong> right to use <strong>the</strong> respective title <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with <strong>the</strong> holder’s name <strong>in</strong> legal<br />

transacti<strong>on</strong>s and socially. Under German law <strong>the</strong>se degrees enjoy special protecti<strong>on</strong> aga<strong>in</strong>st abuse and c<strong>on</strong>fusi<strong>on</strong>. Abusive use<br />

of academic titles is punishable.<br />

A number of study courses lead<strong>in</strong>g to occupati<strong>on</strong>s <strong>in</strong> which <strong>the</strong> public have a special <strong>in</strong>terest are c<strong>on</strong>cluded with a State<br />

exam<strong>in</strong>ati<strong>on</strong> (Staatsprüfung). This is so <strong>in</strong> <strong>the</strong> case of medic<strong>in</strong>e, dentistry, veter<strong>in</strong>ary medic<strong>in</strong>e, pharmacy, law, food chemistry<br />

and teach<strong>in</strong>g careers. For pers<strong>on</strong>s with law and teach<strong>in</strong>g degrees, <strong>the</strong> first State exam<strong>in</strong>ati<strong>on</strong> degree certificate provides access<br />

to a fur<strong>the</strong>r phase of tra<strong>in</strong><strong>in</strong>g known as preparatory service (Vorbereitungsdienst). This period of preparatory service is<br />

c<strong>on</strong>cluded with a fur<strong>the</strong>r State exam<strong>in</strong>ati<strong>on</strong>. This sec<strong>on</strong>d State exam<strong>in</strong>ati<strong>on</strong> qualifies <strong>the</strong> holder for <strong>the</strong> professi<strong>on</strong> <strong>in</strong> questi<strong>on</strong><br />

(e.g. lawyer or teacher).<br />

Successful completi<strong>on</strong> of <strong>the</strong> above exam<strong>in</strong>ati<strong>on</strong>s c<strong>on</strong>stitutes a formal prerequisite for admissi<strong>on</strong> to doctoral programmes (see<br />

Secti<strong>on</strong> II.9); special provisi<strong>on</strong>s apply <strong>in</strong> <strong>the</strong> case of Fachhochschule graduates.<br />

With <strong>the</strong> Council Directive of 21 December 1988 <strong>on</strong> a general system for <strong>the</strong> recogniti<strong>on</strong> of higher educati<strong>on</strong> diplomas<br />

awarded <strong>on</strong> completi<strong>on</strong> of professi<strong>on</strong>al educati<strong>on</strong> and tra<strong>in</strong><strong>in</strong>g of at least three years’ durati<strong>on</strong> (Official Journal of <strong>the</strong><br />

<strong>European</strong> Communities L 19/16, of 24 January 1989) <strong>the</strong> <strong>European</strong> Communities agreed a regulati<strong>on</strong> which does not apply to<br />

a specific occupati<strong>on</strong> but covers higher educati<strong>on</strong> qualificati<strong>on</strong>s ga<strong>in</strong>ed after at least three years of study. It must be<br />

emphasised that <strong>the</strong> directive applies to what are known as <strong>the</strong> ‘regulated professi<strong>on</strong>s’.<br />

II.1. Diplom degree<br />

II.1.1. General characteristics<br />

The Diplom exam<strong>in</strong>ati<strong>on</strong> c<strong>on</strong>stitutes a qualificati<strong>on</strong> entitl<strong>in</strong>g holders to enter a professi<strong>on</strong>. The Diplom exam<strong>in</strong>ati<strong>on</strong> is<br />

designed to establish whe<strong>the</strong>r <strong>the</strong> candidate has a grasp of <strong>the</strong> <strong>in</strong>terrelati<strong>on</strong>ship of aspects of <strong>the</strong> subject, has <strong>the</strong> ability to use<br />

scientific methods and f<strong>in</strong>d<strong>in</strong>gs, and has acquired <strong>the</strong> thorough knowledge of <strong>the</strong> subject necessary <strong>in</strong> professi<strong>on</strong>al practice.<br />

The Diplom degree is awarded by universities to candidates who have passed <strong>the</strong> Diplom exam<strong>in</strong>ati<strong>on</strong>. Courses <strong>in</strong> <strong>the</strong> eng<strong>in</strong>eer<strong>in</strong>g<br />

sciences, natural sciences, ec<strong>on</strong>omics and social sciences lead to <strong>the</strong> Diplom degree, as do cultural and humanities<br />

courses and artistic degree programmes. Diplom degrees at universities and equivalent <strong>in</strong>stituti<strong>on</strong>s of higher educati<strong>on</strong> are<br />

acquired after completi<strong>on</strong> of a broad-reach<strong>in</strong>g course of academic and <strong>the</strong>oretical study. Fachhochschulen award Diplom<br />

degrees follow<strong>in</strong>g successful completi<strong>on</strong> of a practice-oriented academically-based tra<strong>in</strong><strong>in</strong>g course.<br />

Diplom degree courses are characterised by c<strong>on</strong>centrati<strong>on</strong> <strong>on</strong> <strong>the</strong> broad range of <strong>the</strong> ma<strong>in</strong> subject. The purpose of this is to<br />

prevent bias towards <strong>on</strong>e area and to encourage professi<strong>on</strong>al flexibility. In c<strong>on</strong>trast to<br />

n<strong>on</strong>-German degrees, <strong>the</strong> German Diplom degree entitles <strong>the</strong> holder to practise <strong>the</strong> respective professi<strong>on</strong> (effectus civilis).
