I. <strong>Higher</strong> educati<strong>on</strong> system <strong>in</strong> general<br />

The basic pr<strong>in</strong>ciples of <strong>the</strong> educati<strong>on</strong> system are def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>.<br />

The C<strong>on</strong>stituti<strong>on</strong> divides Belgium <strong>in</strong>to three Communities, Flemish, French-speak<strong>in</strong>g and German-speak<strong>in</strong>g, which are<br />

entirely resp<strong>on</strong>sible for educati<strong>on</strong>, except for <strong>the</strong> determ<strong>in</strong>ati<strong>on</strong> of <strong>the</strong> compulsory school<strong>in</strong>g period, <strong>the</strong> divisi<strong>on</strong> of educati<strong>on</strong><br />

<strong>in</strong>to levels (lower, sec<strong>on</strong>dary, higher and university educati<strong>on</strong>) and <strong>the</strong> staff pensi<strong>on</strong> system, which rema<strong>in</strong> <strong>on</strong> <strong>the</strong> federal<br />

level.<br />

In future, educati<strong>on</strong>al affairs of comm<strong>on</strong> <strong>in</strong>terest will be to a larger extent regulated by mutual c<strong>on</strong>sultati<strong>on</strong> and by<br />

c<strong>on</strong>venti<strong>on</strong>s between <strong>the</strong> Communities as <strong>the</strong>y pursue <strong>the</strong>ir own educati<strong>on</strong>al policies.<br />

The organisati<strong>on</strong> of educati<strong>on</strong> is entirely open, i.e. <strong>the</strong>re is no State educati<strong>on</strong> m<strong>on</strong>opoly. Every<strong>on</strong>e has <strong>the</strong> right to educati<strong>on</strong>,<br />

h<strong>on</strong>our<strong>in</strong>g fundamental rights and freedoms.<br />

Instituti<strong>on</strong>s wish<strong>in</strong>g to award recognised diplomas and certificates and wish<strong>in</strong>g to receive subsidies must satisfy <strong>the</strong> relevant<br />

legislative c<strong>on</strong>diti<strong>on</strong>s. Diplomas awarded under <strong>the</strong>se c<strong>on</strong>diti<strong>on</strong>s, whe<strong>the</strong>r by public educati<strong>on</strong>al <strong>in</strong>stituti<strong>on</strong>s or by free<br />

subsidised <strong>in</strong>stituti<strong>on</strong>s, have equal official value.<br />

In this way, all educati<strong>on</strong> <strong>in</strong>stituti<strong>on</strong>s are guaranteed equal treatment.
