Addendum<br />

<strong>Higher</strong> educati<strong>on</strong> reforms<br />

<strong>Higher</strong> educati<strong>on</strong> has recently been <strong>the</strong> subject of extensive reform, to which reference is made <strong>in</strong> Secti<strong>on</strong> I.1.2 of this<br />

document. Apart from what is added here, <strong>the</strong> document was drawn up at a time when <strong>the</strong> reforms had been ratified by formal<br />

decree but not yet applied <strong>in</strong> <strong>the</strong> case of higher educati<strong>on</strong> and were no more than a project <strong>in</strong> <strong>the</strong> case of n<strong>on</strong>-university higher<br />

educati<strong>on</strong>.<br />

Now that <strong>the</strong>se dual reforms are <strong>in</strong> force, <strong>the</strong>re is a need to present <strong>the</strong>m <strong>in</strong> more depth than <strong>in</strong> <strong>the</strong> aforementi<strong>on</strong>ed pages,<br />

despite <strong>the</strong> fact that new implement<strong>in</strong>g decrees are still to be passed and <strong>the</strong> difficulties raised by some of those already<br />

passed are likely to br<strong>in</strong>g amendments <strong>in</strong> <strong>the</strong> near future.<br />

I — Decree of 5 September 1994 <strong>on</strong> university studies and academic degrees<br />

This decree, which entered <strong>in</strong>to force at <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g of <strong>the</strong> 1995/96 academic year, essentially replaces <strong>the</strong> coord<strong>in</strong>ated laws<br />

of 31 December 1949 <strong>on</strong> <strong>the</strong> c<strong>on</strong>ferment of academic degrees.<br />

The new measures have <strong>the</strong> effect of:<br />

<strong>in</strong>creas<strong>in</strong>g <strong>the</strong> aut<strong>on</strong>omy of <strong>the</strong> <strong>in</strong>stituti<strong>on</strong>s,<br />

tak<strong>in</strong>g better account of <strong>the</strong> needs and <strong>in</strong>terests of <strong>the</strong> student,<br />

simplificati<strong>on</strong> at two levels:<br />

(a) <strong>in</strong> <strong>the</strong> statutory status of <strong>the</strong> degrees awarded<br />

(b) <strong>in</strong> <strong>the</strong> names of <strong>the</strong> various diplomas.<br />

(1) Measures <strong>in</strong>troduc<strong>in</strong>g greater aut<strong>on</strong>omy<br />

The decree of 5 September 1994 is not <strong>the</strong> first piece of legislati<strong>on</strong> to grant more aut<strong>on</strong>omy to universities, or even <strong>the</strong> <strong>on</strong>ly<br />

<strong>on</strong>e <strong>in</strong> this period, as a decree of 10 April 1995, for example, c<strong>on</strong>fers greater resp<strong>on</strong>sibility up<strong>on</strong> universities <strong>in</strong> appo<strong>in</strong>t<strong>in</strong>g<br />

teach<strong>in</strong>g and scientific pers<strong>on</strong>nel.<br />

As regards our own field of <strong>in</strong>terest, <strong>the</strong> academic authorities receive new resp<strong>on</strong>sibilities <strong>in</strong> two ma<strong>in</strong> areas:<br />

<strong>the</strong>y <strong>the</strong>mselves determ<strong>in</strong>e <strong>the</strong> c<strong>on</strong>tent of courses, provided <strong>the</strong>y <strong>in</strong>clude at least <strong>the</strong> study of <strong>the</strong> pr<strong>in</strong>cipal subject matter<br />

of <strong>the</strong> discipl<strong>in</strong>e which determ<strong>in</strong>es <strong>the</strong> degree toge<strong>the</strong>r with subject matter ensur<strong>in</strong>g <strong>the</strong> general educati<strong>on</strong> of students;<br />

<strong>the</strong>y are competent <strong>in</strong> <strong>the</strong> area of <strong>the</strong> equivalence of foreign diplomas <strong>in</strong> all cases where <strong>the</strong> request is for academic<br />

purposes al<strong>on</strong>e (<strong>the</strong> c<strong>on</strong>t<strong>in</strong>uati<strong>on</strong> of studies), and for higher sec<strong>on</strong>dary educati<strong>on</strong> teach<strong>in</strong>g diplomas and third-cycle<br />

diplomas (see also <strong>the</strong> implement<strong>in</strong>g decree of 28 August 1996).<br />

(2) Measures <strong>in</strong>troduc<strong>in</strong>g greater flexibility for students<br />

(a) The diploma of aptitude for higher educati<strong>on</strong> (DAES) hav<strong>in</strong>g been abolished from <strong>the</strong> end of 1993, <strong>the</strong> certificate of<br />

advanced sec<strong>on</strong>dary educati<strong>on</strong> (CESS) now permits access to any form of higher educati<strong>on</strong> (except for university studies<br />

<strong>in</strong> applied science, for which a special admissi<strong>on</strong> exam<strong>in</strong>ati<strong>on</strong> still applies), provided:<br />

it was obta<strong>in</strong>ed after <strong>the</strong> 1992/93 academic year;<br />

certa<strong>in</strong> strands of professi<strong>on</strong>al sec<strong>on</strong>dary educati<strong>on</strong> have not been taken.
